City has an agreement with the Oregon Division of Lands (ODSL) to restore and <br />enhance wetlands to satisfy wetland mitigation obligations for permitted wetland impacts. <br />B. T'he City is currently charging $30,000 per mitigation credit, to recover the City's cost <br />of developing and maintaining mitigation.wetlands. <br />C. It has been mutually agreed between ODEQ, the Corps of Engineers and the City that <br />mitigation requirements for development of property identified as Tax Lots 3700, Parcel 1, <br />Assessor's Map No. 17-03-15-34, ("Subject Property") located within the City of Eugene can be <br />satisfied through the purchase of mitigation credits from the West Eugene Mitigation Bank Program. <br />D. Developer desires to fi110.18 acre of wetland, and to purchase from City mitigation <br />credits to satisfy Developer's mitigation obligations. <br />E. Under Corps Pernuti Application No: 95-282, Developer is responsible for securing <br />0.18 acres of mitigation credit. <br />AGREEMENT <br />1. Developer wi11 pay City the amount of $5,400 for mitigation credits. <br />2.
