^ .. <br />c.. The Premises shall not be used for the operation of any garbage dump or sanitary <br />' land fill. If such use is made of the property, State may, at its election, enter upon said land <br />and restore it to the coridition that existed prior to said use for garbage dump or sanitary land <br />fill purposes and recover tHe cost thereof from the Purchaser. <br />All of the above restrictions shall be confined to those Lots in which the State has some title, <br />right or interest hereunder. <br />6. INDEMNIFICATION. Purchaser shall indemnify and hold State harmless from <br />liability for injury or damage to person ar property using the Premises, unless such injury or damage <br />is caused in substantial part by the State's negligence or intentional acts. <br />7. CONVEYANCES; DEEDS. Upon execution ofthis Contract, Purchaserwill deliver <br />to State a payment of $12,000 to be deducted from the purchase price, and State will convey by its <br />bargain and sale deed the parcel shown in the Lane County land records as Lot 13, Block 3, <br />REPLAT OF VICTORIA HEIGHTS, Lane County, Oregon. Upon such conveyance and without <br />further action by either party, Lot 13, Block 3 shall be removed from and no longer constitute a part <br />of the Premises subj ect to the provisions of this Contract. As Purchaser and Purchaser's legal <br />representatives or assigns shall pay the several sums of money aforesaid, punctually and at the time <br />above specified, then State will give unto Purchaser and Purchaser's heirs, successors and assigns, <br />without any further action on the part of Purchaser, additional deeds conveying the Lots, as <br />follows: As Purchaser pays the purchase price of the Lots according to the terms of this Contract, <br />and reduces the principal balance owing to $96,000, $80,000, 64,000, 40,000,18,000 and zero, State <br />will give Purchaser one or more deed(s) to those Lots shown on the attaehed Schedule "A" next to <br />the appropriate principal balance. , <br />All executed deeds of conveyance shall be delivered to City at the following address: <br />DEEDS SHALL BE SENT TO: <br />Russ Royer, Real Property Manager <br />City of Eugene <br />858 Pearl <br />Eugene, Oregon 97401 <br />Each conveyance shall operate to remove the real property described in the deed(s) from the <br />Premises. State shall have no right, title or interest in any Lot conveyed to Purchaser by deed, and <br />Purchaser shall hold absolute title to the property so conveyed free of any right, title or interest of <br />State under this Contract or otherwise. <br />S. CONDITIONS, RESERVATIONS, AND RESTRICTIONS. The property sold <br />shall be subject to the following conditions, reservations, and restrictions, and the deed of <br />conveyance shall contain the following provisions with regard thereto: <br />Land Sale Contract - 3 <br />
