developers will be made in accordance with the provisions of this Section <br />9.2.2. Designs for adding improvements to the site shall not be ,prepared <br />before consulting with interested parties for this site, including friends of <br />Steve Prefontaine and family, members of the track and field community, the <br />Fairmount Neighborhood organization, immediate neighbors of the park, and <br />appropriate City staf£ Scale of development, site impact and maintenance <br />capability and limitations shall be considered as the design is developed. The <br />site designer may be a City staff landscape architect (time permitting) or a <br />privately practicing landscape architect. Interested parties shall have the <br />opportunity to review and approve the site development plan prior to <br />implementation. If there is not a consensus opinion about the plan, the City <br />Manager or his designee shall mediate and specify a design recommendation <br />that represents a compromise between realistic, but differing, points of view. <br />Any permits needed to implement the proposed improvements shall be paid <br />for with donated funds. <br />9.2.3 Not later than one (1) year after the date on which all parcels of the Property <br />have been deeded to the City, the City may begin the following <br />improvements on the Property: <br />i) dedication of additional rights of way which may be required to <br />expand the parking facility, <br />ii) improvements supporting passive recreational uses, including, but not <br />limited to, historical displays, biographical information, memorabilia <br />and artwork, relating to Steve Prefontaine. <br />The City's obligation to make the improvements described in Section 9.2.2 <br />above shall be subject to the availability of funds. The City agrees to work <br />with Benefactor for the design and placement of improvements funded by <br />Benefactor. <br />10. Notice.
