J <br /> 7.1 Responsibilities According to Function. Each of the parties has the authority <br /> to perform the responsibilities assigned to that party in this Agreement. The parties <br /> recognize that their individual authority overlaps some of the tasks performed by other <br /> parties. The parties recognize the value of an agreement that provides for cooperation <br /> and shared ,implementation of their responsibilities. The City's responsibilities derive <br /> <br /> _ from the City's functions in the area, which include: flood control; storm drainage and <br /> other utility infrastructure services; water quality control; construction and maintenance <br /> of a transportation infrastructure; :land use planning; community development; and land <br /> ownership and stewardship. BLM's responsibilities derive from BLM's functions in <br /> the area, which include management of public lands as a national resource; a mandate <br /> to cooperate with local agencies and organizations; and land ownership and <br /> stewardship. TNC's responsibilities derive from TNC's functions in the area, which . <br /> include: a commitment to sensitive areas and ecosystems protection; involvement and _ <br /> developing expertise in wetlands research; and land ownership and stewardship. <br /> 7.2 Description of aesponsibilifies. The parties have agreed on a division of <br /> responsibilities, and have described ahis division in Exhibit B, "Description of <br /> Responsibilities for Wetland Executive Team Partners," which, by this reference is <br /> incorporated and made a part of this Agreement. .The parties may amend Exhibit B as <br /> changes in circumstances warrant. <br /> 7.3 Administration. This ~ agreement has, and other agreements between the <br /> ~ parties and other entities may-have, assigned to the parties joint responsibilities <br /> concerning implementation af. the Plan. These assignments contemplate joint action by <br /> the parties to this agreement. The parties agree.that all joint administrative <br /> responsibilities within the contemplation of this agreement will be carried out by and <br /> through WET, with additional delegation, where necessary, made by and through <br /> WET. The parties agree to the following specific aspects of administration, and may <br /> make additional specific administrative decisions as necessary. <br /> 7.3.1 The annual meeting of WET shall be the regularly scheduled fall <br /> meeting of WET, as provided in section 3.2 of this agreement. - <br /> 7.3.2 WET will provide staffing direction to any Mitigation Bank that is <br /> formed in accord with the Plan. Staffing direction includes, but is not limited <br /> to; selection of a Bank Manager where necessary. <br /> . 7.3.3 WET will provide direction for the operation and management activities <br /> of a Mitigation Bank. . <br /> WET Memorandum of Agreement Page 3 <br /> <br />
