The site shall be available to compensate for projects that requir-e wetland <br /> compensatory mitigation under ORS 196.825 -and are authonzed by federal <br /> nationwide permit. _ . <br /> 2. The compensatory mitigation may be used to satisfy Oregon DEQ's compensatgry <br /> mitigation requirements for Clean Water Act section 401 certification. <br /> 3. The City shall develop a wetland site restoration plan for site E2e That specifies area <br /> • of wetland types to be developed and available for compensatory mitigation. DSL <br /> and DEQ v~nll approve the plan if consistent with the WEWP. <br /> 4. The City shall utilize the Mitigation Replacement <br /> Schedule in the WEWP to <br /> determine wetland replacement requirements. <br /> 5. The City shall be responsible for wetland restoration and monitoring. <br /> 6. The City shall report progress to the Division and DEQ annually on or before <br /> December 1 for a period of 7 .years. <br /> 7. The City shall develop along-term management agreement with the Eugene District <br /> of the Bureau of Land Management to ensure long-term wetland protection on the <br /> site.. <br /> 8. Upon formation of the WEW Bank, the City will transfer its obligation for wetland <br /> management, monitoring and reporting under-this MOA to the Bank. <br /> 9. The Division of State Lands shall review the wetland restoration efforts and specify <br /> _ any changes necessary to achieve the statedwetland foals. <br /> 10. Upon completion of site restoration, remaining funds will be turned over to the WEW <br /> Bank to be utilized for wetland restoration in the WEWP study area and required <br /> management, monitoring and reporting. <br /> Modificcabiion and Termination <br /> This agreement can be modified by mutual consent of all parties. If disagreements <br /> occur, the parties shall submit to mediation to resolve differences. <br /> The agreement shall become effective on the date of the- last signature of the parties <br /> involved.
