The State will reimburse <br />Agency for the federal portion. The cost between the total expenditure and the <br />federal reimbursement will constitute the Agency's match. State's estimated cost for <br />work, done by the State, is $10,000. State's Regional Local Agency Liaison shall send <br />monthly expenditure account SEA} invoices to Agency's Project Manager. Agency <br />understands that State's costs are estimates only and agrees to reimburse State for <br />the actual amount expended. <br />3~ Agency shall select consultants, design, advertise, bid, award the construction <br />contract, and perform construction contract administration. Agency understands that <br />this Project is a test project and agrees to comply with all of the terms and conditions <br />found in Certification Program Agreement No. 24651. <br />4. The federal funding for this Project is contingent upon approval by the Federal <br />Highway Administration ~FHVIJA}. Any work performed prior to acceptance by FHwA <br />will be considered nonparticipating and paid for at Agency expense. The Catalog of <br />Federal Domestic Assistance ~CFDA}numberfor this Project is 20,205. <br />5. State considers Agency asub-recipient ofthe federal funds underthis Agreement. <br />6. State and Agency grant each other authority to enter onto the other's right of way for <br />the performance of this Project. <br />1. Agency shall, upon completion of the Project, maintain the roadway at its awn <br />expense. <br />8. The term of this Agreement shall begin on the date ail required signatures are <br />obtained and shall terminate upon completion of the Project and final payment or ten <br />X10} calendar years following the date all required signatures are obtained, whichever <br />is sooner. <br />9. Local Agency Certification Program Agreement No. 24651 must be fully executed <br />before any work can begin on this Project. <br />10. This Agreement shall supersede and replace Agreement No. 23076 and its <br />supplements in its entirety. Agreement No. 23076 will be terminated upon execution <br />of this Agreement. Invoices for preliminary engineering work incurred prior to the <br />replacement of Agreement No. 23076 can be invoiced by Agency and paid for by <br />State underthis Agreement, <br />11.
