April 22; 2004 Public Works <br />Engineering <br /> City of Eugene <br /> 858 Pearl Street <br />Richard and Cynthia Shaffner Eugene, Oregon 97401 <br />4529 Doyle Street (541) 682-5291 <br />(541) 682-5032 Fax <br />Rugene, tJR 97404 (541) 682-5245 TTY <br />RE: 211 River Avenue (1703-33-22, TL 1300) River Avenue Improvement Project <br />Dear Mr. and Mrs. Shaffner: <br />'T'his letter will confirm our recent telephone discussions. <br />In consideration of the planned city project captioned above, and as owners of the <br />captioned property, it is agreed that the City shall: 1) acquire additional right-of--way, <br />2) acquire a temporary construction easement, and 3) shall purchase the right to remove <br />the large tree which is generally southwest of the existing house. <br />The proposedright-of--way consists of 732 square feet of property along River Avenue <br />and the proposed temporary construction easemern consists of 745 square feet. These <br />areas are further discussed in the original appraisal dated 11/14/03 and are shown on the <br />attached project nvap. Additionally, the owner agrees to allow the City to acquire the <br />rights of removal of the large tree. The total just compensation is.agreed to be $7,432.00. <br />It is requested by the owners to Bass the check through to the buyers of the property <br />(Janell and Mike Cobarrubias). It is acknowledged that the buyers have previously <br />agreed to these figures in their memo to the City dated Apri121, 2004. <br />The escrow officer-and buyer have asked that the eoxnpensation check not pass through <br />escrow as it may create conflicts with the lender's documents. The parties have agreed to <br />simply.: mail .the check directly to :the buyers (Cobarrubias) when available next Thursday. <br />Once the Street deed is signed today, the City will have the document recorded and <br />immediately send a cdpy to western Pioneer Title for their use prior to closing the <br />transaction on Tuesday. <br />Respectfully, <br />Lloyd ~illams <br />Real Property Officer <br />Acknowledged and Accepted: ~ _ <br />
