April 16, 2004
Michael P. Ke ey, PC
Attorney at, ,aw
260 Cour~ry Club Road
,$uite 210
Public Works
Engineering
City of Eugene
858 Pearl Street
Eugene, Oregon 97401
(541)682-5291
(541)682-5032 Fax
(541) 682-5245 TTY
OR 97401
RE: our telephone discussion of April 15, 2004/Meeker Family Limited Partnership
Dear Mr. Kearney:
On March 31, 2004, the City of Eugene offered your client $808.00 for a temporary
construction easement, a public utility easement, and the purchase of two fir trees, as
shown on the previously presented project maps. (Also see enclosed easement
attachments. )
In our discussion referenced above, you indicated that your client was willing to settle for
$1,808.00.
The City has reluctantly approved the requested sum as an administrative settlement.
I am enclosing the easements referenced above for your client's notarized signature.
Additionally, please have Mr. Meeker sign the acceptance of offer on page two of this
letter and return the entire letter along with the signed and notarized easements to my
attention at this office at your earliest convenience- Please bear in mind that time is of
the essence and we must have the signed documents back by Monday Apri126, 2004.
Once I have the documents, 1 will order a check in the amount indicated above and will
forward the check to either you or Mr. Meeker (please instruct) within two weeks of
receiving all signed the documents.
As was discussed in the City's March 24~ offer letter, the project map attached to the
Temporary Construction Easement map shows the proposed construction area as it
affects the Meeker property- In order to match existing ground contours, fill material is
planned to provide a smooth transition from the back of the sidewalk through the
property owner's fence- Mr. Meeker asked for assurances that his fence would not be
damaged or have to be relocated because of the project. City assurance that the fence
will not be harmed or be required to be moved still stands. Further, it was agreed that fill
material will simply pass through the fence a distance of approximately one foot. The
depth of the fill at the bottom of the fence is anticipated to be less than six-inches.
