action or claim is brought against the City, the operator shall, if the <br /> <br /> ~y,,. City so elects and upon tender by the City, defend the same at the opera- <br /> tor's sole expense and cost, promptly satisfy any judgment adverse to the <br /> City or to City and operator jointly, and reimburse the City for any <br /> loss, cost, damage or expense suffered or incurred by the City, including <br /> any legal fees, or fines paid to the FAA or any other governmental agency <br /> arising from the operator's activities. <br /> 6.3.15 Vending Machines. An operator shall not install or operate <br /> vending machines, pay telephones, coin-operated amusement machines or <br /> devices in or upon any leased premises, except as approved by City. <br /> City specifically reserves the right to arrange for the installation <br /> of such machines or devices and such other concessions as the City may <br /> desire. <br /> 6.3.16 National Emergencies. During time of war or national emer- <br /> gency, the City shall have the right to lease the Airport, or any part <br /> of the Airport to the United States for military use. Any permit, <br /> lease, or authority granted under these rules shall be subject to and <br /> controlled, in the event of inconsistency, by that government lease. <br /> 6.3.11 Existing and Future Government Agreements. Any permit, <br /> lease, or agreement entered into under these rules shall be subject to <br /> the terms the sponsor's assurances and agreements now required or~imposed <br /> in the future between the City and the FAA or its successor, any exist- <br /> ing or future agreement between the City of Eugene and the United States, <br /> Vim, and to any directive from the FAA or its successor to the City, relative <br /> to the operation or the maintenance of the Airport or the obtaining of <br /> federal grants. <br /> 6.3.18 Airport Layout Plan/Airport Master Plan. The City reserves <br /> the right to make changes in the Airport Layout Plan and Airport Master <br /> Plan. The City reserves the power to designate as common use areas any <br /> areas which have not been specifically leased or reserved to any person <br /> or party by a written agreement. <br /> 6.3.19 City Use of Leased land. The City has the right to tempor- <br /> arily occupy any part of an area which has been leased or reserved to <br /> any person by a written agreement, so long as the City use does not <br /> interfere with the principal use of the land by the lessee or permittee. <br /> The City may require any structure or building on any leased property <br /> to be relocated on the property if the relocation is needed in connec- <br /> tion with an expansion or improvement of the Airport. The City shall <br /> pay the operator compensation for any temporary or permanent taking to <br /> the extent required by law. <br /> 6.3.20 Discrimination. No person shall, in the use of the Airport <br /> ~or any of its facilities, discriminate or permit discrimination against <br /> any person on the grounds of race, color, creed, national origin, sex <br /> or age, or otherwise discriminate in violation of federal, state or <br /> local law. Each operator shall furnish all services authorized or <br /> licensed by the City of Eugene by charging fair, reasonable and not un- <br /> justly discriminatory prices for each unit of service; provided, however, <br /> Rules - 20 <br /> <br />
