.s~ SS -9/- i~ <br /> ADMII~IISTRATIVE ORDER <br /> of the <br /> <br /> ~Ilr City Manager of the City of Eugene <br /> Emergency Rule R-5.045 -Establishing Procedures <br /> for Appealing Traffic Control Administrative Actions <br /> The ity Manager of the City of Eugene finds that: <br /> A. Under the provisions of Section 5.040 of the Eugene Code, 1971, the City <br /> Manager h authority to administratively establish, maintain, remove or alter traffic control <br /> areas and t affic control devices. Such action is subject to appeal in the manner set forth <br /> in Section .045 of the Eugene Code, 1971. <br /> B. Section 2.019 of the Eugene Code, 1971 authorizes the City Manager to <br /> adopt rules necessary for the administration or enforcement of provisions of the Eugene <br /> Code, 1971. <br /> C. The City traffic engineer, as designee of the City Manager, is frequently <br /> required to establish, maintain, remove or alter traffic areas and traffic control devices. <br /> These actin s cover a wide range of activity, and it would therefore be in the public <br /> interest to romulgate rules establishing the procedures to be followed with respect to <br /> r appeals inv lying those traffic control administrative actions. <br /> D. Because these types of administrative actions occur on a regular and routine <br /> basis, failur to act promptly in adopting this Rule will seriously prejudice the public <br /> interest in at no clear guidelines presently exist for processing appeals under Section <br /> 5.045 of th Eugene Code, 1971 of traffic control administrative actions of the City <br /> Manager or the Manager's designee. <br /> Now, therefore, based upon the above findings, <br /> I h reby adopt the following Procedures for Appealing Traffic Control <br /> Administrat a Actions Administrative Rule R-5.045: <br /> PROCEDURES FOR APPEALING TRAFFIC CONTROL <br /> ADMINISTRATIVE ACTIONS EMERGENCY RULE R-5.045 <br /> R-5.045-A AUTHORITY. <br /> Thes regulations are authorized by Section 2.019 of the Eugene Code, 1971, and <br /> Administrat' a Order - 1 <br /> <br />
