ADMINISTRATIVE ORDER NO. 5&92-03

~ of the
City Manager of the City of Eugene
Revising Methodologies:
City of Eugene Systems Development Charges
The City Manager of the City of Eugene finds as follows:
A. Sections 2.020 and 7.710 of the Eugene Code, 1971 authorize the City
Manager to determine and set fees and charges to be imposed by the City for services,
goods, use of municipal property, licenses and permits, including those set forth in the
Methodologies: City of Eugene Systems Development Charges, adopted by the Council
on May 8,' 1991.
B. In accordance with the procedures set forth therein, on December 13, 1991
I notified the Mayor and City Council that I intended to revise the rate-setting
methodologies for transportation systems development charges to include additional caps
for p.m. peak hour trip rates, as set forth in the Notice of Intended Methodologies: City
of Eugene', Systems Development Charges attached as Exhibit A thereto. The Notice was
also posted at two locations at City Hall on December 17, 1991, and made available to
interested persons at the office of the City Manager. The Notice provided that written
comments, would be received thereon for a period of 15 days from the first date of posting.
No written comments were received within the time provided in the Notice.
C. ' I find that the rate-setting methodologies hereinafter set forth would result
in transportation system development charges that are consistent with applicable policies
and directives of the City Council; are consistent with the system development charge
methodolggy adopted by the City Council; and will impose an equitable share of the public
cost of capital unprovements upon developments that are capped.
On the basis of these findings I order that:
1. Paragraph 3 under Section 3.2 of the Methodologies: City of Eugene Systems
Development Charges, adopted by the Council on May 8, 1991 is amended to provide:
The trip rates contained in this Manual have been adjusted by staff to reflect
pass-by trips. This is accomplished by setting caps of ten trips per Thousand Gross
Square Feet and 5.10 trips per Pump for respective developments. This adjustment
would generally encompass developments which might be considered pass-by in
nature.
2. Except as herein amended, all other provisions of the Methodologies: City
~r Administrative Order - 1
