`
ADMINISTRATIVE ORDER NO. ~ - Z
of the
CITY MANAGER OF THE CITY OF EUGENE, OREGON
Extending the Effective Date of
Emergency Rule R-5.040 -Establishing Residential
Permit Parking Zone Regulations
Thel City Manager of the City of Eugene tlnds that:
A. Pursuant to the authority of Section 5.040 of the Eugene Code, 1971, which
authorizes ,'the City Manager to establish parking zones or restrict parking upon the streets
of the Cityj, and Section 2.019 of the Eugene Code, 1971, on August 15, 1991 I adopted
Emergency Rule R-5.040 -Establishing Residential Permit Parking Zone Regulations.
B. Prior to its expiration on February 15, 1992, Emergency Rule R-5.040 was
extended fbr an additional 30-day period by Administrative Order No. 58-92-OS to allow
an opportdnity to adopt the rule as a permanent rule. Publication of the notice of intent
to adopt ~mergency Rule R-5.040 as a permanent rule was defective, and the effective
date of Emergency Rule R-5.040 should therefore be extended for an additional 30 days.
C. Section R-5.040-C of Emergency Rule R-5.040 should also be amended to
provide an', additional process for establishment of residential permit parking zones by the
Traffic Engineer as hereinafter more particularly set forth, and a new Section R-5.040-Q
added therleto to authorize a reduction or waiver of fees and the criteria therefor.
D. The program being administered pursuant to Emergency Rule R-5.040 affects
the public welfare and safety, and the public interest will be prejudiced if the effective date
is not extended and amended as provided herein.
Nowt, therefore, based upon the above findings,
1. Residential Permit Parking Zone Regulations Emergency Rule R-5.040-C is
hereby amended to provide:
R-S.g40-C INITIATION.
1. Application by owner/resident. A request to establish a residential
permit parking zone shall be submitted to the City on a form provided by or
appt~oved by the City.
