ADMINISTRATIVE ORDER NO. 58-93- ~ 0
of the
City Manager of the City of Eugene
CONCERNING NOTICE OF INTENDED MWMC EQUALIZATION FEES
The City Manager of the City of Eugene finds as follows:
I
II A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to
,determine and set fees and charges to be imposed by the City for services, goods, use of
'municipal property, and licenses and permits. In accordance with the procedures set forth
therein, and the further authority of Section 7.710 of the Eugene Code, 1971, on June 29,
1992 I adopted Administrative Order No. 58-92-13 establishing Metro Wastewater
Management Commission (MWMC) Facilities Equalization Fees and Credits for the fiscal
year commencing July 1, 1992.
B. The MWMC Equalization Fee is a systems development charge paid by
property owners and developers for new construction that is connecting to the sanitary sewer
for the first time, and for the expansion of existing commercial and industrial development
that increases demand on the sanitary sewer system. The fee is administered and collected
j by the City for property within the City's service area.
C. There are two classifications to the Equalization Fee. The Residential Fee is
i applicable to single family residences and residential uses of up to two dwelling units, with
the fee being based on the number of dwelling units in the development. All other uses are
~I
classified as Commercial/Industrial, with the fee being calculated on the number of plumbing
I; fixture units in the development. The fee for existing Commercial/Industrial property
connecting to the sanitary sewer system for the first time is based on the amount of water
used by the existing development.
~I~ D. A one-time credit is available for newly connecting property within the City
i and for property outside the City. The amount of credit for newly connecting property
within the Ci is based on the date of annexation to the City, the date of construction of
tY
I~, any improvements since 1978, and the current value of the land and improvements. For
I~ development outside the City, the credit is based on the date of assessment for the sewer,
'the date of construction of any improvements, and the current value of land and
improvements.
E. MWMC has requested a revision in the MWMC Facilities Equalization Fee
and Credits for the fiscal year beginning July 1, 1993, and I find the proposed fees are
'i established in an amount designed to equal the amount existing system users have paid for
reserve capacity since 1978, are in conformity with adopted City policies and guidelines,
including Sections 2.020 and 7.710 of the Eugene Code, 1971, and I therefore intend to
repeal the currently effective fees and credits set forth in Administrative Order No. 58-92-13
and establish MWMC Facilities Equalization Fees and Credits for the 1993-94 fiscal year as

~,j set forth in the Notice of Intended Fees attached as Exhibit A hereto and incorporated
Administrative Order - 1
