<br /> i <br /> ADMINISTRATIVE ORDER NO. 58-94-O1-F <br /> of the <br /> City Manager of the City of Eugene <br /> ESTABLISHING RIGHT OF <br /> WAY USE PERMIT FEES <br /> The City Manager of the City of Eugene finds as follows: <br /> A. following the procedures then in effect, the Council by Ordinance adopted in <br /> 1925 established minimum excavation fees, and other right-of--way use permit fees in 1980 <br /> by Resolution Nos. 3323 and 3324. <br /> B. 'The provisions of Sections 2.020 and 7.290 to 7.340 of the Eugene Code, 1971 <br /> authorize the City Manager to determine and set fees and charges to be imposed by the City <br /> for services, goods, use of municipal property, licenses and permits, and specifically including, <br /> <br /> ~ fees for permits, activities, or uses affecting the public right-of--way. <br /> <br /> i <br /> C. In accordance with the rocedures set forth there' on March 4 1994 I <br /> P ~ , <br /> notified the Mayor and City Council that i intended to increase the right-of--way use permit <br /> fees as set forth in the Notice of Intended Fees attached as Exhibit A thereto. The Notice <br /> <br /> ~ as also posted at two locations at City Hall, and made available for inspection by interested <br /> ersons at the offices of the City Engineer, 858 Pearl Street, Eugene, Oregon 97401 during <br /> ormal business hours (8:00 a.m. to 5:00 p.m., Monday through Friday, exclusive of <br /> olidays). Tht Notice provided that written comments would be received thereon for a <br /> eriod of 15 days from the first date of posting. No responses were received within the time <br /> r ~n the manner required by the Notice. <br /> D. T' find that the fees set forth in Exhibit A hereto are consistent with applicable <br /> olicies and directives of the City Council, including policies developed through the Eugene <br /> ecisions process, are based on the City's estimation of the costs associated with performing <br /> he services, and are necessary in order to recover those costs from the beneficiaries of the <br /> ervices. <br /> On the basis of these findings, I order that: <br /> 1. The fees set forth in the Right-of--Way Use Permit Fee Schedule attached as <br /> bit A hereto are hereby established as the fees to be charged for the services set forth <br /> herein. <br /> 2. Effective April 4, 1994, the fees set forth in Exhibit A hereto replace and <br /> upercede any prior fees established for the same or similar services. <br /> Dated this day of 1994. <br /> Micheal D.
