i <br /> A I I .58-9403-F <br /> of the <br /> City Manager of the City of Eugene <br /> j ' ESTABLISHING A FEE FOR STORMWATER CUSTOMER <br /> SERVICE CHARGE APPEALS PURSUANT TO <br /> SECTION 6.416 OF THE EUGENE CODE, 1971 <br /> The City Manager of the City of Eugene finds as follows: <br /> A. Sections 2.020 and 6.416 of the Eugene, Code, 1971 authorizes the City <br /> IVZanager of the City of Eugene to determine and set fees and charges to be imposed by the _ <br /> City for services, goods, use of municipal property, and licenses grid permits, and specifically <br /> the fee for appeals of stormwater customer service charges. <br /> B. In accordance with the procedures set forth therein, on March 4, 1994 I <br /> notified the Mayor and City Council that I intended to establish a fee for appeals of <br /> stormwater customer service charges as set forth in the Notice of Intended Fees attached <br /> as Exhibit A thereto. The Notice was also posted at two locations at City Hall, and made <br /> available for inspection by interested persons at the offices of the City Engineer, 858 Pearl <br /> Street, Eugene, Oregon 97401 during normal business hours (8:00 a.m. to 5:00 p.m., Monday <br /> through Friday, exclusive of holidays). The Notice provided that written comments would <br /> br? received thereon for a period of 15 days from the first date of posting. No responses <br /> were received within the time or in the manner required by the Notice. <br /> C. I find that an appeal fee of $100 for appeals of stormwater customer service <br /> <br /> i <br /> charges is consistent with applicable policies and directives of the City Council, including <br /> tlxose developed during the Eugene Decisions process, the amount charged for comparable <br /> appeals, and is necessary in order to recover the costs incurred by the City in processing <br /> such appeals. <br /> On the basis of these findings, I order that: <br /> An appeal fee of $100 is hereby established for appeals of stormwater customer <br /> service charges, to become effective April 4, 1994. <br /> Dated this . ~ i day of 4 ~«u ~A 1994. <br /> Micheal D.
