' i <br /> <br /> r <br /> ADMINISTRATIVE ORDER NO. 58-94-11 <br /> o f th e <br /> City Manager of the City of .Eugene <br /> CONCERNING NOTICE OF PROPOSED INCREASE LN <br /> WASTEWATER USER FEES AND REPEAL OF ADMINISTRATIVE <br /> ORDERS NO. 58-93-OG AND NO. ~8-94-08 <br /> i <br /> III <br /> The City Manager of the City of Eugene finds as follows: <br /> A. Section 6.411 (fo?-merly Sectia~ 7.020) of the Eugene, Code, 1971 authorizes the <br /> City Manager to determine and set fees and charges to be imposed by the City for wastewater <br /> service and fo,r regional wastewater service. In accordance with the procedures set forth therein, <br /> on May 15, 193 I adopted Administrative Order No. 58-93-06 establishing sewer user rates for <br /> I, the fiscal yea+` commencing July 1, 1993 and ending June 30, 1994. <br /> ~I <br /> I~ I3. Notice of the proposed wastewater service charges to begin on July 1, 1994 was <br /> originaly provided by Administrative Order 58-94-08, dated May 1.7, 1994. Due to an error in <br /> ~'i publication of the Notice by the Register Guard, it is necessary to provide new Notice of the <br /> proposed wastewater charges and to reschedule the public hearing on those proposed charges. <br /> C. Pursuant to Subsection 6.41.1(1) of the Eugene Code, 1971, I have conducted an <br /> investigation of the revenue needs of the City in providing these services and reviewed the <br /> !I recommendation of the Metropolitan Wastewater Management Commission (MWMC). <br /> D. Based on that investigation and recommendation, Iintend to increase the user fees <br /> II for wastewater service and regional wastewater treatment service as set forth in the Notice o,f <br /> ~ Intended Fees' attached as Exhibit A hereto and incorporated herein by reference, and repeal the <br /> currently effective fees established by Administrative Order No. 58-93-06. I find the proposed <br /> feces are in compliance with the Council's directive that the costs of providing such services be <br /> recovered from the beneficiaries of the services, and other applicable policies and directives of <br /> thie Council; are consistent with applicable federal and state regulations and the recommendations <br /> oi± MWMC; are comparable to the amounts charged by the Ciry of Springfield and other such <br /> service providers; will preserve equity between different classes of ratepayers; and are based on <br /> I, the proposed budget of the City of Eugene and the adopted budget of MWMC. <br /> On the basis of these findings, I order that: <br /> 1. Copies of the Notice be provided to the Mayor and City Councilors, the news <br /> ~I media, an_y person who has requested notice, to interested governmental agencies (including the <br /> United States Enviro+unental Protection Agency, the Department of Environmental Quality, <br /> I, M~~~MC, and the Eugene \~~ater & Electric Board), posted at two locations at City Hall, published <br /> o?~ two separate occasions in the Register Guard, a newspaper of general circulation within the <br /> City, and be made available for interested persons at the offices of the Public Works Department, <br /> ~i S58 Pearl Street, Eugene, Oregon 97401, during normal business hours (8:00 a. m. to 5;00 p.m., <br /> Monday through Friday, exclusive of holidays). <br /> Administrative Orrlcr - I <br /> I <br /> <br />
