tl ADMINISTRATIVE ORDER NO. ~8-94-I1 of the ~ City 1\lanager of the City of Eugene CONCERNING NOTICE OE .PROPOSED INCREASE IN j WASTE~~1'ATER USER FEES AND REPEAL OF ADMINISTRATIVE ORDERS NO. 58-93-OG AND NO. 58-94-08 The City Manager of the City of Eugene ends as follows: A. Section 6.411 (formerly Section 7.020) of the Eugene, Code, 1971 authorizes the Ciry Manager to determine and set fees and charges to be imposed by the City for wastewater service and for regional wastewater service. In accordance with the procedures set forth therein, on May 15, 193 I adopted Administrative Order No. 58-93-06 establishing sewer user rates for the fiscal year commencing July 1, 1993 and ending June 30, 1994. i3. Notice of the proposed wastewater service charges to begin on July 1, 1994 was originaly provided by Administrative Order 58-94-08, dated May 1.7, 1994. Due to an error in publication of the Notice by the Register Guard, it is necessary to provide new Notice of the proposed wastewater charges and to reschedule the public hearing on those proposed charges. C. Pursuant to Subsection 6.41.1(1) of the Eugene Code, 1971, I have conducted an investigation of the revenue needs of the Ciry in providing these services and reviewed the recommendation of the Metropolitan Wastewater Management Commission (MWMC). D. Based on that investigation and recommendation, Iintend to increase the user fees for wastewater service and regional wastewater treatment service as set forth in the Notice of ~ I+tended Fees attached as Exhibit A hereto and incorporated herein by reference, and repeal the ~U currently effective fees established by Administrative Order No. SS-93-O6. I find the proposed j fees are in compliance wifh the Council's di?-ective that the costs of providing such services be recovered fro+~~ the beneficiaries of the services, and other applicable policies and directives of the Council; are consistent with applicable federal and state regulations and the recommendations of. M\?VMC; are comparable to the amounts charged by the City of Springfield and other such service providers; will preserve equity between different classes of ratepayers; and are based on j' the proposed budget of the City of >sugene and the adopted budget of MWMC. i On the basis of• these findings, I order that: 1. Copies of the Notice be provided to the Mayor and Ciry Councilors, the news media, any person ~-vho has requested notice, to interested governmental agencies (including the United States Environmental Protection Agency, the Department of Environmental Quality, M\\'MC, and the Eugene \\'ater & Electric Board), posted at two locations at City Hall, published on two separate occasions in the Register Guard, a newspaper of general circulation within the City, and be made available for interested persons at the offices of the Public Works Department, SSS Pearl Street, Eugene, Oregon 97401, during normal business hours (5:00 a.m. to 5:00 p.m., Monday through Friday, exclusive of holidays).
