~ a <br /> 1 <br /> ADMINISTRATIVE ORDER NO. 58-94- <br /> of the <br /> City Manager of the City of Eugene <br /> <br /> ' ESTABLISHING RATES FOR MAINTENANCE SERVICES <br /> FOR SIDEWALK REPLACEMENT AND GRINDING <br /> <br /> ~ The City Manager of the City of Eugene finds as follows: <br /> <br /> III A. .Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to <br /> determine and set fees and charges to be imposed by the City for services, goods, use of <br /> municipal property, and licenses and permits. <br /> <br /> i <br /> B. 1n accordance with the procedures set forth therein, and the further <br /> authority of Section 7. i 30 of the Eugene Code, 1971, on July 1, 1994 I notified the <br /> Mayor and City Council that i intended to increase the currently effective rates for <br /> maintenance services for sidewalk replacement and grinding. The Notice was also <br /> published in the Register-Guard newspaper on June 23-27, posted at two locations at City <br /> H811 on June 23, 1994, and made available for inspection by interested persons at the <br /> <br /> 'i offices of the', City Manager, 777 Pearl Street, Room 105, Eugene, Oregon 97401 during <br /> normal busindss hours (8:00 a.m. to 5:00 p.m., Monday through Friday, exclusive of <br /> holidays). The Notice provided that written comments would be received thereon for a <br /> period of 15 days from the date of publication and posting. No comments were received <br /> within the time or in'the manner required by the Notice. <br /> C. J find that the rates set forth in Exhibit A hereto are consistent with <br /> applicable poljcies and directives of the City Council, comparable to the rates established <br /> in other jurisdictions for providing such services, and are necessary in order to comply <br /> with the City Council's directive and the requirements of Section 7.130 of the Eugene <br /> Cade, 1971 thhat the rates charged for these services recover the City's full costs. <br /> <br /> I <br /> <br /> ~I~ On the basis of these findings, I order that: <br /> 1. The rates set forth in Exhibit A hereto are hereby established as the rates to <br /> <br /> II be,charged fort the engineering services for privately constructed public improvements as <br /> sex forth therein. <br /> ' <br /> <br /> I, 2.
