w:
I
MEMORANDUM
Date: November 1, 1994
From: Les Lyle
To: Chris Andersen, Mike Gleason
i
',Subject: Emergency Administrative Order
I
~ ~ Attached is a administrative order that we need to execute today. Over the past few
;weeks we ha a been implementing the stormwater rate adjustments in response to
I, Council actin in September, 1994. One issue that we could not resolve prior to
implementati n November 1, 1994 was how to handle those accounts with
exemptions. t present there are a limited number of customers that have full
exemptions f r properties that do not discharge directly or indirectly to the public
;system or ha a containment systems on-site. The exemptions have been focused on
~ the water qu lity and quantity elements since the road element did not exist. An
example of a exemption is Downtown Mini-Storage. They drain their site into a
,'series of dry- ells and based on the adopted methodology are fully exempt from the
~ Fuser fee. Th y have approximately 300,000 sf of impervious area and based on the
road element of the user fee ($0.70/1000sf), they would now be expected to pay $240
per month. gain, their are a limited number of commerciaVindustrial sites that have
full exemptio s. There are also a limited number of residential customers with full
exemptions a d they would begin to pay a Small charge.
A greater nu ber of customers have reductions such as a portion of the parking lot at
Valley River enter that drains to the Willamette. That area is not included in the
current calcul tion of rates but under the new road rate structure that area would now
I ;pay $0.70 pe 1000sf with the balance of the impervious area paying an increase of
$0.30 per 10 0 sf. Other public sites would now be charged for the road share such
as the imperv ous area for the bike path system along the river, 4J and Mari~t school
sites, etc. Th se accounts will be adjusted with the November billings to reflect the
jchange in sta us of the impervious areas.
Since the me hodology document is silent on how to handle the road element, I have
oncluded th t the intent of the Council was not to provide reductions and exemptions
or that portio of the rate for any customer. We are proposing to not collect the fee
or those pro erties that are exempt now but will fet it accrue over the next two months
hile we mod fy the methodology document. At that time we will send a bill for the
ccrued amo nt along with that current months billing. Taking this approach will also
~e consistent ith any new measure 5 requirements if it should pass. Modifying the
methodology ocument will follow procedures as outlined in the administrative order.
dope this all akes sense and we can execute this order today. If you have
