i <br /> I <br /> <br /> ,i <br /> RULES GOVERNING USE OF MAHLON SWEET AIRPORT <br /> 1. SCOPE <br /> 1.1 These rules govern all persons on the Airport and users <br /> of the Airp rt. Any direct or indirect permission given to a person to enter <br /> upon or use the Airport is conditioned, unless otherwise agreed, upon compli- <br /> ance with t ese rules. <br /> 1.2 These rules do not amend, modify or super- <br /> sede any pr vision of federal, state or local law or of any contract between <br /> the City of Eugene and an Airport user. Insofar as possible, these rules shall <br /> be interpre ed not to conflict with, but to supplement, federal, state or <br /> local law o any contract between the City of Eugene and an Airport user. <br /> 1.3 These rules are adopted and can be amended under. the <br /> authority o Section 2.430(1) of the Eugene Code, 1991. Rulemaking follows <br /> the process s set out in Sections 2.430 of the Eugene Code, 1991. <br /> 1.4 These rules shall be posted at the offices of <br /> the Airport Manager and the City finance Officer. <br /> 1.5 The adoption of these rules <br /> is not rote ded to and shall not be construed to grant any property right or <br /> expectation to any person. The City reserves the right to amend these rules <br /> and to limi or deny any person's use of the Airport as may be in the public's <br /> interest. <br /> 1.6 ales to be Administered Fairly and Impartially. The rules allow <br /> substantial discretion to the Airport Manager in granting, denying, or <br /> revoking pe mits and leases. The rules also require the Airport Manager to <br /> grant, deny or revoke permits or ~ieases only when such action will serve the <br /> public rote est. <br /> 1.7 These rules are severable. If any part of these <br /> rules in in alidated by a court or agency, that invalidation shall not affect <br /> the validit of the remaining rules. <br /> 2. As used herein, the following words and phrases mean: <br /> 2.1 - any activity which involves, makes <br /> possible, o is required for% <br /> the operation or safety of aircraft used fore <br /> private, bu mess, recreational, or agricultural purposes. "Aeronautical <br /> activity" d es not include activities of any local, state, or federal agency, <br /> including t e military, or an isolated use of the airfield by an aircraft. <br /> 2.2 t - any contrivance used or designed for navigation or <br /> flight in t e air. <br /> 2.3 t e- c ee - a written lease agreement <br /> which grant exclusive use of the aircraft to the lessee for the purpose of <br /> !meeting the requirements of Section 7 of these rules and regulations. <br /> <br />
