ADMINISTRATIVE ORDER NO. 58-95-03 <br /> of the <br /> City Manager of tl~e City of Eugene <br /> CONC RNING NOTICE OF INTENDED INDUSTRIAL PRETREATMENT <br /> PROGRAM FEES <br /> The C'ty Manager of the City of Eugene finds as follows: <br /> A. Sections 2.020 and 6.546 of the Eugene Code, 1971 authorize the City Manager of <br /> the City of Eu ene to determine and set fees and charges to be imposed by the City for services, <br /> goods, use of unicipal property, and licenses and permits, and specifically charges and fees to be <br /> paid by the ind strial users of the City wastewater system who are subject to the provisions of <br /> Sections 6.501 to 6.596 of the Eugene Code, 1971. In accordance with the procedures set forth <br /> therein, I inten to establish fees for: (a) annual industrial discharge permit; (b) filing an appeal of <br /> an administrati a penalty; and (c) recovery of time and resource costs associated with resampling <br /> violations, as s t forth in the Notice of Intended Fees attached as Exhibit A hereto and <br /> incorporated h rein by reference. <br /> B. I find that the fees set forth in Exhibit A hereto are consistent with applicable <br /> policies and di ectives of the City Council, including those developed during the Eugene <br /> Decisions pro ss, and the provisions of Section 6.546 of the Eugene Code, 1971, that requires <br /> fees be establis ed that reduce the City's costs associated with setting up and operating the <br /> pretreatment p ogram; establishing sampling, monitoring, inspection, and surveillance procedures; <br /> reviewing acci ental discharge procedures and controls; and processing permit applications, and <br /> should becom effective June 1, 1995. <br /> On the asis of these findings, I order that: <br /> 1. Copies of the Notice be provided to the Mayor and City Councilors, published in <br /> the Register ard, a newspaper of general circulation within the City, posted at two locations at <br /> City Hall, and a made available for inspection by interested persons at the offices of the City <br /> Manager, 777 earl Street, Eugene, Oregon 97401 during normal business hours (8:00 a.m. to <br /> 5:00 p.m., Mo day through Friday, exclusive of holidays). <br /> 2. All persons desiring-fo comment thereon shall submit written comments as set <br /> forth in the No ice.
