<br /> 'k <br /> ADMINISTRATIVE ORDER N0.58-95-03-F <br /> of the <br /> City Manager of the City of Eugene <br /> ESTABLISHING INDUSTRIAL PRETREATMENT <br /> PROGRAM FEES <br /> The C ty Manager of the City of Eugene finds as follows: <br /> A. Sections 2.020 and 6.54b of the Eugene, Code, 1971 authorize the City Manager of <br /> the City of E gene to determine and set fees and charges to be imposed by the City for services, <br /> goods, use of unicipal property, and licenses and permits, and specifically charges and fees to be <br /> paid by the in ustrial users of the City wastewater system who are subject to the provisions of <br /> Sections 6.501 to 6.596 of the Eugene Code, 1971. <br /> B. In accordance with the procedures set forth therein, on Apri127, 1995 I notified the <br /> Mayor and Ci Council that I intended to establish fees for: (a) annual industrial discharge permit; <br /> (b) filing an ppeal of an administrative penalty; and (c) recovery of time and resource costs <br /> associated with resampling violations, as set forth in the Notice of Intended Fees attached as Exhibit <br /> A thereto and ' corporated therein by reference. The Notice was also posted at two locations at City <br /> Hall on April 8, 1995, published in the Register Guard, a newspaper of general circulation within <br /> the City on Ap ' 30, 1995, and made available for inspection by interested persons at the offices of <br /> the City r, '177 Pearl Street, Eugene, Oregon 97401 during normal business hours (8:00 a.m. <br /> to 5:00 p.m., onday through Friday, exclusive of holidays). The Notice provided that written <br /> comments wo ld be received thereon for a period of 15 days from the first date of posting and <br /> publication. comments were received within the time or in the manner required by the Notice. <br /> C. I find that the fees set forth in Exhibit A hereto are consistent with applicable policies <br /> and directives f the City Council, including those developed during the Eugene Decisions process, <br /> and the provisi ns of Section 6.546 of the Eugene Code, 1971, that requires fees be established that <br /> reduce the C ty's costs associated with setting up and operating the pretreatment program; <br /> establishing piing, monitoring, inspection, and surveillance procedures; reviewing accidental <br /> discharge pr ores and controls; and processing permit applications, and should become effective <br /> June 1, 1995. <br /> On the basis of these findings, I order that: <br /> J' <br /> The fe s set forth on Exhibit A attached hereto and incorporated herein by reference are <br /> hereby establis ed as the fees to be charged for the services set forth therein, commencing June 1, <br /> 1995. <br /> Dated his day of May, 1995. <br /> C' icheat D , ~eason <br /> ~I City M Hager <br /> <br />
