_ <br /> ADMINISTRATIVE ORDER NO. 58-95-OS <br /> of the <br /> City Manager of the City of Eugene <br /> CONCERNING NOTICE OF PROPOSED INCREASE IN <br /> W STEWATER USER FEES AND REPEAL OF ADMINISTRATIVE <br /> ORDER NO. 58-94-11-F <br /> The ity Manager of the Ciit;y of Eugene finds as follows: <br /> A. Section 6.41 ] (formerly Section 7.020) of the Eugene, Code, 1971 authorizes the <br /> City Manage to determine and set fees and charges to be imposed by the City for wastewater <br /> service and f r regional wastewater service. In accordance with the procedures set forth therein, <br /> on June 23, 994, I adopted Administrative Order No. 58-94-ll-F establishing sewer user rates <br /> for the fiscal year commencing July 1, 1994. <br /> li. Pursuant to Subsection 6.4 t 1(1) of the Eugene Code, 1971, I have conducted an <br /> investigation of the revenue needs of the City in providing these services and reviewed the <br /> recommends. ion of the Metropolitan 1~Vastewater Management Commission (MWMC). <br /> C. The MWMC has revised the method used to allocate costs among customer <br /> classes, and 1 as also reallocated costs between the flat monthly component of the MWMC fee <br /> and the flow based component of that fee. The customer service charges reconnnended by <br /> MWMC refl ct this revised cost allocation. <br /> D. Based on that investigation and recommendation, Iintend to revise the user fees <br /> for wastewat r service and regional wastewater treatment service as set forth in the Notice of <br /> Intended Fee attached as Exhibit A hereto and incorporated herein by reference, and repeal the <br /> currently effe tive fees established by Administrative Order No. 58-94-11-F. I find the proposed <br /> fees are in c mpliance with the Council's directive that the costs of providing such services be <br /> recovered fro n the beneficiaries of the services, and other applicable policies and directives of <br /> the Council; re consistent with applicable.federal and state regulations and the recommendations <br /> of MWMC; re comparable to the amounts charged by the City of Springfield and other such <br /> service provi ers; will preserve equity between different classes of ratepayers; and are based on <br /> the proposed udget of the City of >;ugene and the adopted budget of MWMC. <br /> i <br /> On th basis of these findings, I order that: <br /> 1.
