ADMINISTRATIVE ORDER NO. 58-95-06-F <br /> <br /> ' of the <br /> City Manager of the City of Eugene <br /> ES BLISHING MWMC EQUALIZATION FEES AND REPEALING <br /> ADMINISTRATIVE ORDER NO. 58-94-10-F <br /> The 'ty Manager of the City of Eugene finds as follows: <br /> A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to determine <br /> and set fees d charges to be imposed by the City for services; goods, use of municipal property, <br /> and licenses d permits. <br /> B. In accordance with the procedures set forth therein, and the further authority of <br /> Section 7.710 f the Eugene Code, 1971, on May 15, 1995 I notified the Mayor and City Council <br /> that I intende to repeal the currently effective Metro Wastewater Management Commission <br /> (MWMC) Fa 'litres Equalization Fees axd Credits set forth in Administrative Order No. 58-94- <br /> 10-F and esta lish those fees and credits beginning in the 1995-96 f scal year as set forth in <br /> Exhibit A to dministrative Order No. 58-95-06 issued on May 11, 1995. The Notice was also <br /> published in t e Register Guard and posted at two locations at City Hall on May 15, 1995, and <br /> made availabl for inspection by interested persons at the offices of the City Manager, 777 Pearl <br /> Street, Eugen ,Oregon 97401 during normal business hours (8:00 a.m. to 5:00 p.m., Monday <br /> through Frida ,exclusive of holidays). The Notice provided that written comments would be <br /> received ther n for a period of 45 days from the first date of publication and posting. No <br /> written respo es were received within the time or in the manner required by the Notice. <br /> C. As indicated in Administrative, Order No. 58-95-06: <br /> 1.: The MWMC Equalization Fee is a systems development charge paid by <br /> prope owners and developers for new construction that is connecting to the sanitary <br /> sewer or the first time, and for the expansion of existing commercial and industrial <br /> develo ment that increases demand on the sanitary sewer system. The fee is administered <br /> and co lected by the City for property within the City's service area. <br /> 2. There are two classifications to the Equalization Fee. The Residential Fee <br /> is appl cable to single family residences and residential uses of up to two dwelling units, <br /> with th fee being based on the number of dwelling units in the development. All other <br /> uses ar classified as Commercial/Industrial, with the fee being calculated on the number <br /> of plu Bing fixture units in the development. The fee for existing Commercial/Industrial <br /> prope connecting to the sanitary sewer system for the first time is based on the amount <br /> of wat r used by the existing development. <br /> 3. A one-time credit for prior property tax payments on MWSD bonded debt <br /> is avai able for newly connecting property. The amount of credit for newly connecting <br /> prope within the City is based on the date of annexation to the City, the date of <br /> constr ction of any improvements since 1978, and the current value of the land and <br /> Administrati a Order - 1 <br /> <br />
