NOTICE OF INTENDED RULEMAKING <br /> O ONE PROTECTION ADMINISTRATIVE RULE R-6.725 <br /> NOTI E >~S HEREBY GIVEN that pursuant to the authority contained in Sections <br /> <br /> 2.019 and 6.72 of~the Eugene Code, 1971, Micheal D. Gleason, City Manager of the City of <br /> <br /> Eugene, intend t adopt as a permanent rule the Proposed Ozone Protection Administrative <br /> Rule R-6.725 pr posed by Administrative Order No. 58-95-11 of the City Manager, which: <br /> e s forth the manner in which the rules are intended to implement <br /> Section 6.00 to 6.725 of the Eugene Code, 1971, which were adopted by the <br /> City C nail to reduce the sale and use of ozone depleting products within the <br /> -City; a tal~lishes the process for making determinations that products are <br /> prohibi ed ozone-depleting products; provides the e$'ective date of such <br /> determ nations; establishes procedures for appeals from determinations; sets <br /> forth th criteria and methodology for prohibiting ozone-depleting products or <br /> exclusi n ~f products from prohibition; establishes the criteria for designating <br /> additio al ilnzone-depleting chemicals; establishes procedures for processing <br /> citizen c mplaints; and sets forth the procedures for imposition of <br /> admini ra~ive civil penalties, and the settlement and/or appeal of such penalties. <br /> The P posed Ozone Protection Administrative Rule R-6.725, is necessary for the <br /> preservation of he, safety and welfare of the public, and in compliance with the City Council's <br /> directive as a deiced by Sections 6.700 to 6.725 of the Eugene Code, 1971 adopted by the <br /> Council, and ay,be reviewed at the office of the City Manager, City Hall, 777 High Street, <br /> Eugene, Oreg n'~7401 during normal business hours. <br /> All per n~ wishing to comment thereon or object thereto must submit their comments <br /> or objections o the Public Works Department, 858 Pearl Street, Eugene, Oregon 97401, in <br /> writing, within ift~en (15) days of the date of the first publication hereof, as indicated below. <br /> The City Man gei- will thereafter adopt the Proposed Ozone.Protection Administrative Rule <br /> R-6.725, as a er#nanent Rule. <br /> I <br /> MICHEAL D.
