Bas d ~ n fhe criteria contained in section R-6.725-D, the City Manager shat! <br /> etermine wh th~r safe and cost-effective alternatives exist for (1) al! plastic foam <br /> i sulation pro uc s, (2) other products containing HCFCs, and (3) pesticides <br /> ontaining HC C 123, CFC 113, methyl bromide, or any other ozone-depleting <br /> hemical whic i installed with an agent containing HCFC 123, CFC 113 or methyl <br /> romide. The r ess for making such a determination with respect to any of the <br /> roducts inclu a with these three categories shall begin with the Lane Regional Air <br /> ollution Auth rit ("LRAPA") providing to the-City Manger information about the <br /> xistence of a er atives to the ozone depleting chemical. <br /> 2. Bas d ~ n the criteria set forth in R-6.725-D, the City Manager also may <br /> etermine tha of er products not covered by subsection 1 are ozone-depleting <br /> roducts for w i safe and cost-effective alternatives exist. This process also shah <br /> egin with. rec ip of information from LRAPA regarding the ozone-depleting nature of <br /> he product, a d he existence of alternative products which are safe and cost- <br /> ffective. <br /> 3. Any E gene resident or person with a business operating within Eugene <br /> ay request t e ity Manager to determine that other products not covered by <br /> ubsection 1 re ozone-depleting products for which safe and cost-effective <br /> Iternatives a istF Such requests must include information that addresses the criteria <br /> et forth in R .725-D. LRAPA will consider these requests when it periodically <br /> evelops infor ~tion regarding the ozone-depleting nature of other product, and the <br /> xistence of a terlnative products which are safe and cost-effective. <br /> 4. FoH wing receipt from LRAPA of the information specified in subsections 1 <br /> nd 2, and ba a on that information and the criteria contained in section R-6.725-D, <br /> he City Mana a shall make an initial determination as to whether the ozone <br /> epleting pro uc should be prohibited. The City Manager shall provide notice of <br /> ntent to decl a he product as a prohibited ozone-depleting product or a non- <br /> rohibited oz ne depleting product, and provide an opportunity to submit comments <br /> hereon. Upo piration of the comment period, the City Manager shall consider the <br /> mments re ei ed,. and based thereon, issue a notice of the proposed decision with <br /> espect to the pr duct. In addition to other notice provided, the City Manager shall mail <br /> otice to any a son who commented on the proposed decision. <br /> 5. An p rson who commented on the proposed decision and who disagrees <br /> ith that deci io may, within 15 days from the date of the decision, appeal the <br /> etermination to a hearings official appointed by the City. The hearings official's <br /> <br /> . ecision shall b~ final, and shall be based solely on whether the criteria of a safe, <br /> cost-effective alternative product being available has been met. <br /> Proposed Oz ne Protection Administrative Rule - 3 07/06/95 <br /> <br />
