Sections 2.440 to 2.442 of the Eugene Code, 1971, authorize the City Manager or designee to <br /> set fees and cha gel for the use of the Eugene Airport. Under Airport Rule 8.4.2., the City Manager has delegated <br /> that authority t ll~e Airport Manager. <br /> B. Lt accordv~ce ~a~th the proced~u-es set forth in Sections 2.440 to 2.442 of the Eugene Code, 1971, <br /> on August li, 99~, !issued Administrative Order No. _i8-9~-12 proposing to increase the airport tie-down fees, <br /> which were p vipusly established on August 1980, as set forth in the Notice of Intended Fees attached as <br /> Exhibit A they to. The Notice was provided to the Mayor and City Councilors, posted at two locations at the <br /> Airport on Au Est ! 8, 1991. published u~ the Register Guard, a newspaper of general circulation within the City, <br /> on August 20 1 ~9~, and made available for inspection by interested persons at the offices of the Airport <br /> Manager, 288 1,~clJ~eed Drive, Eugene, Oregon 97402, during normal business hours (8:00 a.m. to 5:00 p.m., <br /> Monday tluou ~ F~•iday, exclusive of holidays). The Notice provided that written co~runents would be received <br /> thereon for a p ri~ of 1 ~ days Gom the first date of posting and publication. No responses were received within <br /> the time or in t ~e i~nanner required by the Notice. <br /> C. t~fter investigating the fees charged at other airports, the City's policies on recovery of user fees, <br /> and the revers ?e needs of the Eugene Airport, I have detern~ined that the current tie-down fees at the Eugene <br /> Airport, whic ~ hi?ve been in effect since August I, 1980, should be increased as set forth in the Airport Fee <br /> Schedule attac red as Exhibit A hereto and incorporated herein by reference. <br /> D. addition to the airport tie-do«m fees, other fees for services at the Airport have from time to <br /> tune been esta list ed by administrative orders. I further find that it would be more efficient to rescind those prior <br /> orders and cor ibir e the fees in the Airport Fee Schedule attached as Exhibit A hereto. <br /> On th b sis of these findings, I order that: <br /> 1. dministrative Order No. i8-91-0 1, and any other order in conflict with the fees established <br /> and/or ratified he ein are rescinded, as <br /> of the effective date of this Order. <br /> 2. he fees set forth in paragn-aph I of the Airport Fee Schedule attached as Exhibit A hereto are <br /> hereby establi he as the Airport Tie-Down Fees, and the fees set forth in paragraphs 2 through 11 are hereby <br /> ratified and a irn ed as the fees to be charged for the sen~ices set forth, as of the effective date of this order. <br /> 3. opies of~tilis Order shall be provided to the Mayor and City Co~u~cilors and to any persons who <br /> have request no ice.
