STORMWATER SYSTEM ADMINISTRATIVE RULE <br /> <br /> A. Definitions. <br /> In addition to the definitions set forth in Sections 6.340, 6.406, and 6.506 of the Eugene <br /> <br /> Code, 1971, as used herein, the following words and phrases mean: <br /> Citv stormwater system. Those stormwater facilities located on City-owned <br /> property, City right-of-way, City easements and any stormwater facility the Ciry is <br /> contractually or legally obligated to operate and maintain, including but not limited to: <br /> 1. An open drainageway serving a drainage basin which has been <br /> accepted by the City; <br /> 2. A pipe or sewer and its related appurtenances which carries <br /> stormwater and have been designed and constructed expressly for use by the <br /> general public and accepted by the City; <br /> 3. Streets, curbs, gutters, and other surfaces in the public way which <br /> are designed to convey stormwater; <br /> 4. Roadside drainage ditches along unimproved City streets, except for <br /> access drive culverts smaller than 24 inches in diameter; and <br /> S. Flood control and stormwater quality facilities (levees, dikes, <br /> overflow channels, detention basins, retention basins, dams, pump stations, <br /> groundwater recharging basins, wetlands, etc.) that have been designed and <br /> constructed expressly for use by the general public and accepted by the City. <br /> lean-u .The containment and/or removal of any substance and the mitigation of <br /> damage to property or the environment to the satisfaction of federal, state, and local <br /> enforcement personnel. <br /> Discharge. Deposition or release of any substance other than stormwater to the <br /> city stormwater system, whether deliberate or as an unintended result of any action or <br /> failure to act. Discharges include but are not limited to surface runoff, dumping, leaching <br /> by stormwater, point source connections, and spilling of pollutants. <br /> Enforcement action. Citations, civil penalties, or abatement charges issued, <br /> assessed, or billed against a responsible party. <br /> Enforcement officer. The Director of the City's Public Works Department, or his <br /> or her designee. <br /> Hindered. Any action which inhibits the ability of City staff to investigate or <br /> mitigate illegal/improper discharges to the city stormwater system. This includes, but is <br /> not limited to: denying access to a facility to City staff or contract workers attempting to <br /> Stormwater System Administrative Rule - 4 <br /> <br />
