' '
ADMINISTRATIVE ORDER NO. 58-95-19-F
I, of the
CITY MANAGER PRO TEM
STORMWATER SYSTEM
ADMINISTRATIVE RULE
Thei CL~ty Manager Pro Tem of the City of Eugene finds that:
i
I
A. Pursuant to the authority contained in Section 2.019 and Chapter 6 of the Eugene
Code, 197, on May 3, 1996 I adopted Administrative Order No. 58-95-19 proposing the
adoption of !a Stormwater System Administrative Rule to establish procedures for an enforcement
program designed to discourage violations of the Eugene Code, 1971 relating to improper
connections and/or illegal discharges to the City's stormwater system, and/or violations of the
City's NPDES stormwater permit and Comprehensive Stormwater Management Plan (CSWMP).
The rule provides a formula for computing the amount of administrative civil penalties, sets forth
enforcement remedies, and provides for the manner in which decisions may be appealed.
B. Notice of the proposed adoption of the Stormwater System Administrative Rule was
published ~ the Register Guard, a newspaper of general circulation within the City for five
consecutive days, to-wit, on May 12, 13, 14, 15, and 16, 1996. The Notice was also made
available to' persons who had requested notice, and made available for inspection by interested
persons at the City's Public Works Department, Administration Division, 858 Pearl Street,
Eugene, Oregon 97401 during normal business hours (9:00 a.m. to 5:00 p.m., Monday through
Friday, exclusive of holidays).
C. The Notice provided that written comments would be received thereon for a period
of 15 days f~o~ the first date of publication. Written comments were received from The Schnitzer
Group, Rex~us Forest By-Products, Inc., and Bulk Handling Systems, Inc., to which I make the
following findings:
+,~omment 1: The proposed rule is redundant and unnecessary due to existing state
and federal regulation of surface water quality and stormwater discharges.
'I
j Finding: As a condition of the City's National Pollution Discharge Elimination
Syst.~m (NPDES) permit, the City is required to implement legal and effective mechanisms
to c nt~ol the quality of the stormwater it is discharging. Although the Department of
Env' or~mental Quality (DEQ) issues NPDES stormwater discharge permits, relatively few
busi es~es operating within the City are required to obtain a NPDES permit, and
resi en~ial violations are not subject to permit requirements. The majority of the City's
bus' es~es and residents are subject to regulation through provisions of the Eugene Code,
1971] (EC). This rule creates a mechanism by which the City can meet its NPDES permit
Stormwater System Administrative Rule - 1
. I,I
I,
i
I
