Sections 2.440 to 2.442 of the Eugene Code, 1971, authorize the City Manager or <br /> j designee to set fees and charges for the use of the Eugene Airport. Under Airport Rule 8.4.2., the <br /> City Manager has 'delegated that authority to the Airport Manager. <br /> B. In accordance with the procedures set forth in Sections 2.440 to 2.442 of the Eugene <br /> Cede, 1971, on May 31, 1996, I issued Administrative Order No. 58-96-12 proposing to increase the <br /> lading fee set forth in section 4 of the Airport Fee Schedule adopted by Administrative Order No. <br /> Sg-95-12 F on October 13, 1995, to revise the terminal building rental rate set forth in Section 5 of <br /> that Schedule, establish a joint use requirement fee,. and delete the current provisions for "New <br /> Signatory" users from both Sections 4 and 5, all as set forth in the Notice of Intended Fees attached <br /> i I„ as; Exhibit A thereto. The Notice was posted at two locations at the Airport on June 4, 1996, <br /> ' published in the Register Guard, a newspaper of general circulation within the City, on June 4, 1996, <br /> and made available for inspection by interested persons at the offices of the Airport Manager, 28E55 <br /> ~ ~ Lgclcheed Drive, Eugene, Oregon 97402, during normal business hours (8:00 a.m. to 5:00 p.m., <br /> i Mpnday through Friday, exclusive of holidays). The Notice provided that written comments would <br /> be received thereon for a period of 15 days from the first date of posting and publication. No <br /> 'i', responses were received within the time or in the manner required by the Notice. <br /> I; <br /> C. After investigating the fees charged at other airports, the City's policies on recovery <br /> I of Buser fees, and the revenue needs of the Eugene Airport, I have determined that Sections 4 and S <br /> of the Airport Fee Schedule should be revised as set forth in Finding B above. I further find that it <br /> j would be more efficient to rescind Administrative Order No. 58-95-12-F as of the effective date of <br /> I this Order, and adopt the amended Airport Fee Schedule attached as Exhibit A hereto, and <br /> ~i incorporated herein by reference. <br /> On the basis of these findings, I order that: <br /> 1.
