<br /> w <br /> i'" <br /> ADMINISTRATIVE ORDER NO. 58-96-22-F <br /> ' of the <br /> City Manager of the City of Eugene <br /> AMENDING TREE PRESERVATION ADMINISTRATIVE RULE R-6.305; <br /> ~ AND REPEALING ADMINISTRATIVE ORDER NO. 58-94-05-F <br /> The City Manager of the City of Eugene finds that: <br /> A. Section 2.019 of the Eugene Code, 1971, authorizes the City Manager to adopt <br /> les for implementation of any provisions of that Code. Section 6.305, which sets out the permit <br /> r quirements, application procedure, and appeal process relating to the tree preservation program, <br /> as amended by Ordinance No. 20056, passed by the City Council and approved by the Mayor <br /> August 5, 1996. ' <br /> B. In accordance with the procedures set forth therein, on December S, 1996, the City <br /> anager Pro Tem issued Administrative Order No. 58-96-22 proposing amendments to the Tree <br /> reservation Administrative Rule R-6.305 as proposed therein, in order to ensure that the City's <br /> ree Preservation Rules are implemented in a manner that is in compliance with the newly <br /> ended provisions of the Eugene Code, 1971: Notice was provided to the Mayor and City <br /> ouncilors, posted at two locations at City Hall on"December 9, 1996, published in the Register- <br /> , uard, a newspaper of general circulation within the Ciry for five consecutive days, to-wit, <br /> ~rrj eccmber 9, 10, 11, 12, and 13, 1996, and made available for inspection by interested persons <br /> I the office of the City Manager, 777 Pearl Street, Eugene, Oregon 97401 during normal business <br /> ours (8:00 a.m. to 5:00 p.m., Monday through Friday, exclusive of holidays). <br /> C. The notice provided that interested persons could submit written comments thereon <br /> r a period of thirty (30) days from the first date of publication and posting. No valid comments <br /> r objections were received within the time and in the manner prescribed in the notice. <br /> Now, therefore, Administrative Order No. 58-94-OS-F is repealed, as of the effective date <br /> f this Order, and Tree Preservation Administrative Rule R-6.305 is hereby amended and/or <br /> r tifed as follows: <br /> T PRESERVATION <br /> ~ ADMINISTRATIVE RULE R-6.305 <br /> -6.305-A DEFINITIONS. <br /> As used herein, the following words and phrases mean: <br /> Lear c t.
