? ~
Comment 3: Is there a fee to determine if a lot is in a sensitive area?
Findinn: Determination of sensitive area will be done at the Permit and Information
Center prior to the submittal of a permit application. Therefore, a fee is not required for this
determination. Once the determination is made and finalized, a formal appeal of this
determination requires a fee.'
Comment 4: Appeal fees aze too high.
Findin The amount of the appeal fee, $175, includes an estimate of time and
materials to hire a hearings official. This amount represents a straight forward appeal issue.
Therefore, there is no need to adjust the rule at this time.
D. In addition to the specific findings set forth above, I find that the fees set forth in
Exhibit A hereto are consistent with applicable policies and directives of the City Council, including
policies developed during the Eugene Decisions process; are compazable to the fees charged for
similar services; and aze necessary t o comply with the Council's directive to recover the City's costs
and expenses in administering such programs from the beneficiaries of the services.
Based on the above findings, which aze hereby adopted, I order that:
The fees set forth in the Erosion Prevention and Construction Site Management Practices
Permits Fee Schedule attached as Exhibit A hereto aze hereby established as the fees to be charged
for the services set forth erein, effective February 1, 1997.
Dated this day of January,1997.
~ o-~
Linda Norris
City Manager Pro Tem
Administrative Order - 2
