i <br /> <br /> ~4r ' ADMINISTRATIVE ORDER NO. 58-97-Q7 <br /> of the <br /> City Manager of the City of Eugene <br /> CONCERNING NOTICE OF INTENDED AMENDMENT OF MWMC <br /> PROVISIOl^iS OF SYSTEMS DEVELOPMENT CHARGE METHODOLOGIES <br /> The City Manager of the City of Eugene finds as follows: <br /> A. Sections 2.020 and 7.705 of the Eugene, Code, 1971 authorize the City Manager <br /> o the City of E~Zgene to determine and set fees and charges to be imposed by the City for <br /> s rvices, goods, t~se of municipal property, and licenses and permits, and specifically systems <br /> d velopment charges. Section 7.710 of the Eugene Code, 1971 further authorizes the City <br /> anager to adopt; and/or amend by administrative order, the methodologies used for establishing <br /> t e systems development charges, and provides this may be effected concurrent with the <br /> e tablishment or irevision of a systems development charge. <br /> B. In accordance with the procedures set forth therein, and in response to a resolution <br /> p ssed by the Metropolitan Wastewater Commission (MWMC), I intend to amend portions of the <br /> S stems Development Charge Methodologies relating to MWMC by: (1) redefining the MWMC <br /> S C as a combined reimbursement fee and improvement fee; (2) adding and defining a flow <br /> e timation units (FEU) category; (3) establishing a process for reviewing the capital improvement <br /> p ogram and calculating the SDC fees to be charged when a large volume user connects to the <br /> s stem; resulting in revisions to the Table of Contents, Table 1 on page 3, Figure 1 on page 5, <br /> tion 4.2 starting on page 7, Table 2 on page 15, Appendix B on pages B-1 and B-2, Appendix <br /> on pages D-6 through D-10, and Appendix G on pages G-3 through G-5; and (4) revising the <br /> t tle and paragraph 1 of the text of Section 2.4 on page 6 by inserting the phrase "City of Eugene" <br /> t clarify it references expending City of Eugene SDC's, all as set forth in the Notice of Intended <br /> endment of 11~WMC Provisions of Systems Development Charge Methodologies attached as <br /> xhibit A heretol~ and incorporated herein by reference. <br /> C. I Find that the revisions to the Methodologies and the fees as set forth in Exhibit <br /> hereto are consistent with adopted policies and ordinances of the Ciry and with policies adopted <br /> y MWMC, in conformity with applicable state law, and should be implemented effective July <br /> 1997, and these portions of the Systems Development Charge Methodologies adopted by <br /> dministrative C'~rder Nos. 58-97-02-F-2 amended as of that effective date. <br /> On the basis of these findings, I order that: <br /> 1. Copies of the Notice be provided to the Mayor and City Councilors, published in <br /> e Register Guard, a newspaper of general circulation within the City, posted at four public <br /> ~ocations, and copies of the Proposed Revisions to the Systems Development Charge <br /> Administrative Order - 1 05/16/97 <br /> i <br /> <br />
