<br /> i <br /> .3 Exceptions to these prohibitions must be approved in writing by the City <br /> Engine r or designee, based on, or subject to the following: <br /> 1.3.1 Requests for approval to open a street whose surface is less than five <br /> ears old shall be reviewed and approved, approved with special conditions, or <br /> enied. Special conditions may include modified or increased pavement restoration <br /> equirements, landscaping, or other requirements to restore disturbed features. <br /> 1.3.2 Examples of conditions which may justify exceptions to the <br /> rohibition include: required excavation to locate existing facilities when installing <br /> new facility by tunneling, boring, or pushing; or to provide necessary utility <br /> ervices to a property where no other practicable alternative exists to provide such <br /> ervice. <br /> 1.3.3 In addition to the standard permit fees, a fee in an amount <br /> stablished by the City Manager pursuant to Section 2.020 of the Eugene Code, <br /> 971 shall be imposed for review and issuance of an exception permit for cutting <br /> street whose surface is less than five years old. <br /> .4 Notwithstanding the provisions of R-7.302-A above, in emergency <br /> situatio verbal authorization may be granted by the Utility Inspector in lieu of a written <br /> author' tion for an exception to the street cut prohibitions. Emergency situations are <br /> those in which immediate repair to damaged or malfunctioning facilities is necessary to <br /> restore ost service to customers. Any verbal authorizations shall be subsequently <br /> docume ted in writing by the Utility Inspector. <br /> 2. otice Requirements. A provider planning to install a new facility, or perform a <br /> major facility u grade, within the public way under a standard right-of--way cut permit, greater <br /> han 400 linear feet but less than 1,000 linear feet, shall provide no less than 90 calendar days <br /> dividual proje t notice to the City and all other utilities and license holders identified in the most <br /> ecent list of pr eiders published by the Utillity Inspector. A copy of the current list of providers <br /> i s attached here o as Exhibit "B" for informational purposes only. The Utility Inspector shall <br /> pdate the list a new providers become active within the City and provide a copy thereof to the <br /> roviders reflec ed in the list. If the proposed work consists of opening more than 1,000 linear <br /> eet but less tha 2,000 linear feet of public way the individual project notice shall increase to a <br /> inimum of 12 calendar days. If the proposed work will open more than 2000 linear feet the <br /> ndividual proje t notice shall increase to 180 calendar days. <br /> Individ al project notices shall be sent by certified mail with return receipt requested. <br /> he notice shall 'nclude the proposed length, scope, location, foot-line, depth and width of trench, <br /> nd nature of f cilities to be placed. The notice shall also state whether a street opening for <br /> lacement of fa ilities has been conceptually approved by the City.
