S q' 7 -O P <br /> of the <br /> City Manager of the City of Eugene <br /> I <br /> j CONC RNING NOTICE OF INTENDED CONSTRUCTION WITHIN AND USE OF <br /> THE PUBLI WAY PERMIT FEES AND AMENDMENT OF THE RIGHT-OF-WAY USE <br /> PERMIT FE S SCHEDULE ESTABLISHED BY ADMINISTRATIVE ORDER 58-96-13-F. <br /> The Ci Manager of the City of Eugene finds as follows: <br /> A. ursuant to the provisions of Sections 2.020 and 7.300 of the Eugene Code, 1971, on <br /> i July 16, 1996, e City Manager Pro Tem issued Administrative Order 58-96-13-F establishing a fee <br /> for long-term se of the surface of the public right-of--way, adopting a revised right-of--way use <br /> permit fee sch dule, and repealing Administrative Order No. 58-94-O1-F, all as set forth therein. <br /> B. ection 7.300 of the Eugene Code, 1971, which was recently revised, authorizes the <br /> City Manager t establish fees for implementation of the City's program for construction within and <br /> ,use of the publ' way. It would be more efficient to consolidate those right-of--way cut permit fees <br /> with the previ sly established right-of way use fees in one schedule. <br /> i <br /> C. find that the proposed increase in excavation permit fees and new right-of--way cut <br /> permit fees fo construction within and use of the public way set forth on Exhibit A hereto are <br /> consistent with applicable policies and directives of the City Council, including policies developed <br /> <br /> ~ through the Eu ene Decisions process, are based on the City's estimate of the costs associated with <br /> providing the ervices, and are necessary in order to implement newly revised provisions of the <br /> Eugene Code, 971 and recover these costs from the beneficiaries of the services. <br /> On the asis of these findings, I order that: <br /> 1. opies of the Notice be provided to the Mayor and City Councilors, posted at two <br /> locations at Ci Hall, be made available for interested persons at the offices of the City Manager, <br /> 777 Pearl Stre t, Eugene, Oregon 97401, during normal business hours (8:00 a.m. to 5:00 p.m., <br /> `Monday throu h Friday, exclusive of holidays), and published in the Register Guard, a newspaper <br /> of general circ lation within the City. <br /> <br /> i <br /> 2. 11 persons desiring to comment thereon shall submit written comments as set forth <br /> in the Notice. will thereafter establish the fees by an administrative order. <br /> Dated his day of June, 1997 <br /> v <br /> V' Ci^ ty <br /> N~anager <br /> Administrativ Order 05/30/97 <br /> <br />
