<br /> i <br /> o <br /> ADMINISTRATIVE ORDER NO. 5$-97-17 <br /> of the <br /> City Manager of the City of Eugene <br /> ~ CON ERNING NOTICE OF INTENDED AMENDMENT OF INDUSTRIAL <br /> PRETREATMENT PROGRAM FEES <br /> The qty Manager of the City of Eugene finds as follows: <br /> ~ A. Sections 2.020 and 6.546 of the Eugene, Code, 1971 authorize the City <br /> Manager oft a City of Eugene to determine and set fees and charges to be imposed by <br /> the City for ervices, goods, use of municipal property, and licenses and permits, and <br /> specifically arges and fees to be paid by the industrial users of the City wastewater <br /> system who re subject to the provisions of Sections 6.501 to 6.596 of the Eugene Code, <br /> 1971. <br /> B. In accordance with the procedures set forth therein, on May 26, 1995 the City <br /> Manager iss ed Administrative Order No. 58-95-06-F establishing fees for: (a) annual <br /> industrial di charge permit; (b) filing an appeal of an administrative penalty; and (c) <br /> recovery of ti a and resource costs associated with resampling violations, as set forth in <br /> E~Chibit A the eto. <br /> C. I intend to amend that fee schedule to establish fees for (a) mobile waste <br /> hauler initial pplication and permit; (b) mobile waste hauler biannual permit renewal; (c) <br /> industrial w ste and contaminated groundwater discharge application; (d) grease trap <br /> wtaste surch rge; and (e) to revise the manner in which the mobile waste hauler septage <br /> d'~scharge fe is computed, as set forth in the Notice of Intended Fees attached as Exhibit <br /> hereto an incorporated herein by reference. <br /> D. I find that the fees set forth in Exhibit A hereto are consistent with applicable <br /> pplicies and directives of the City Council, including those developed during the Eugene <br /> decisions p ocess, and the provisions of Section 6.546 of the Eugene Code, 1971, that <br /> requires fee be established that reduce the City's costs associated with setting up and <br /> c~erating th pretreatment program; establishing sampling, monitoring, inspection, and <br /> surveillance procedures; reviewing accidental discharge procedures and controls; and <br /> processing ermit applications. <br /> On th basis of these findings, t order that: <br /> 1.
