f <br /> <br /> i ' ADMINISTRATIVE ORDER NO. 58-97-18-F <br /> ' ~ of the <br /> AIItPORT MANAGER <br /> r <br /> RE ING THE AIRPORT FEE SCHEDULE BY DELETING COMMERCIAL AND <br /> ~ NON-CO RCIAL LAND RENTAL RATES AND THE OLD TOWER BUILDING <br /> ' LEASE ;AND REPEALING ADMINISTRATIVE ORDER NO.58-97-10-F. <br /> The Airport Manager of the City of Eugene finds as follows: <br /> A. Authority is granted to the City Manager of the City of Eugene under Sections 2.440 <br /> to 2.442 of he Eugene Code, 1971 to set fees and charges for the use of the Eugene Airport. The <br /> City Manag r has further delegated that authority to the Airport Manager under Airport Rule 8.4.2. <br /> B. Pursuant to that delegated authority Administrative Order No. 58-97-10-F was issued <br /> on June 30 1997 revising and ratifying the Airport Fee Schedule attached as Exhibit A thereto, <br /> effective Jul 1, 1997. On August 20, 1997 I issued Administrative Order No. 58-97-18 proposing <br /> the revision f the Airport Fee Schedule by deleting the non-commercial and commercial land rental <br /> rates and th Old Tower Building lease fee set forth in Sections 10 and 11, and renumbering Sections <br /> 12 and 13, s set forth in the Notice of Intended Fees attached as Exhibit A thereto. <br /> ~ C. The Notice was provided to the Mayor and City Councilors, posted at two locations <br /> at the Airp rt on September 2, 1997, published in the Register Guard, a newspaper of general <br /> circulation 'thin the City on September 2, 1997, and made available for inspection by interested <br /> persons at a offices of the Airport Manager, 28855 Lockheed Drive, Eugene, Oregon 97402 during <br /> normal bus' ess hours (8:00 a.m. to 5:00 p.m., Monday through Friday, exclusive of holidays). The <br /> Notice pro ded that written comments would be received thereon for a period of 15 days from the <br /> first date o posting and publication. No comments were received within the time or in the manner <br /> required by the Notice. <br /> D. Subsection (1)(a) of Section 2.440 of the Eugene Code, 1971 exempts from the <br /> ratemaking rocedures those fees, rents or charges provided for by lease, contract or permit with the <br /> City. I find hat all users of the Old Tower Building and non-commercial and commercial land at the <br /> Airport no do so underwritten agreements with the City, and those fees should be deleted from the <br /> Airport Fe Schedule as proposed, and Administrative Order No. 58-97-10-F and the Airport Fee <br /> Schedule a opted therein repealed, as of the effective date of this order. <br /> ~ On he basis of these findings, I order that: <br /> 1. Administrative Order No. 58-97-10-F and the Airport Fee Schedule adopted therein <br /> is hereby r pealed, as of the effective date of this order. <br /> 2. Sections 10 and 11 of the Airport Fee Schedule are deleted, and Sections 12 and 13 <br /> Adminis five Order - 1 <br /> <br />
