S~ tion 2: PERMITS FOR WORK WITNIN THE PUBLIC WAY <br /> 2.A GENERA <br /> No erson or mun cipal utility shall perform work affecting the public way without first <br /> obt fining a permit from the City Engineer. EC 7.290(2) <br /> As sed herein, " ork affecting the public way" includes, but is not limited to, installation, <br /> or c nstruction of ny structure, pipe, conduit, culvert, or facility, including a <br /> cQ munications f cility or other wire line facility in the public way, and any construction, <br /> rec nstruction, gr ding, dust control, repair, opening or excavation of a public way for any <br /> pur ose but does not include the construction of public improvements performed under a <br /> cQn Tact executed by the City Manager or work performed by City employees under the <br /> Ct Manager's di ection. EC 7.290(1) <br /> iss ance of a per it for work within the public way does not relieve the permittee from the <br /> r~s onsibility too fain other necessary permits and to conform to other regulatory <br /> r~q irements. In ertain areas of the public way, location restrictions, setbacks; natural <br /> r~s urce preserv Lion, wetland, or other local, state, or federal regulations may apply. The activi involves the removal and replacement of any City-owned facilities (e.g. <br /> street pav ment, trees, concrete curbs or sidewalks). <br /> The activi y involves the relocation of the existing facility (e.g. changing the foot line <br /> or elevati n of underground facilities or moving existing poles or guy lines to a new <br /> location). <br /> 3. The activi y involves the cutting of any root 2 inches in diameter or greater of a <br /> street tre within the critical root zone of the street tree. <br /> !4. The activi y involves installing more than 100 linear feet of pipe, conduit or cable. <br /> <br /> ~r5.
