NOTICE OF INTENDED RULEMAKING <br /> PROP SED AMENDMENT AND ADOPTION OF CONSTRUCTION <br /> (THIN AND USE OF THE PUBLIC WAY EMERGENCY <br /> AD INISTRATIVE RULE R-7.302 AS A PERMANENT RULE <br /> AN REPEAL OF ADMINISTRATIVE ORDER NO. 58-97-08 <br /> NOTICE S HEREBY GIVEN that pursuant to the authority contained in Sections <br /> 2. 19 and 7.30 of the Eugene Code, 1971, the City Manager of the City of Eugene, <br /> in nds. to adop as a permanent rule Construction Within and Use of the Public Way <br /> ~ ergency Adm nis#rative Rule R-7.302 adopted by Administrative Order No. 58-97-08 on <br /> ! ne 5, 1997, a amended by: <br /> (a) Adding a definition for "conduit" and amending the definition of "street <br /> segment" in R-7.302-B; (b) revising the notice requirements in R-7.302-C to clarify <br /> the purpo a and intent of notification and requiring providers to establish the timing <br /> and form t of the notice with evaluation and monitoring by the City; (c) revising R- <br /> 7.302-D- by adding "pay telephones" and "associated poles or support structuresn <br /> to the no -applicable facilities, revising the location standards in R-7.302-D-2; {d) <br /> adding a rovision to R-7.302-E-3 that requires the City Engineer, with input from <br /> providers to complete a standards development process prior to imposing permit <br /> condition relating to standards for conduit size, capacity to be installed, or the <br /> provision of extra capacity; and (e) deleting the performance bond or security <br /> deposit r quirements of R-7.302-H-2 for issuance of annual blanket permits. <br /> The ame dment and adoption of Construction Within and Use of the Public Way <br /> jE ergency Ad inistrative Rule R-7.302 as a permanent rule is necessary in order to <br /> ~e sure that use of-the public way is in compliance with current provisions of the Eugene <br /> C de, 1971 rela ing to construction and use of the public way.
