Section 4: MAINTENANCE RESPONSIBILITIES <br /> 4.A GENERAL <br /> Patches or excavations within the public way in need of maintenance shall be reported to <br /> the Utility Inspector. In most cases, a utility cut requires maintenance or repair if any part <br /> of the replacement surfacing deviates more than 3/4" from the finished surface street grade <br /> or'/2" from a finished sidewalk grade. <br /> If upon reasonable notice, the permittee fails to restore and maintain the public way <br /> affected by the permittee's work, the City may perform the work and charge the cost to the <br /> permittee. If, in the judgment of the Maintenance Planning Manager, a hazardous or <br /> dangerous condition exists that affects the public health, safety and welfare, the notification <br /> requirement may be waived and the City may take necessary corrective action to remove <br /> the hazardous conditions and charge the costs thereof to the responsible party without <br /> prior notification. EC 7.308 (3) <br /> If more than one permittee has worked within the affected area, the Maintenance Planning <br /> Manager shall allocate the responsibility and cost #or restoration and maintenance. Factors <br /> to be considered in the allocation of responsibility include the nature of~the work each per- <br /> formed, the type of deterioration occurring, when each permittee performed work, the kind <br /> of equipment and construction techniques each used, and other such factors which may <br /> be deemed relevant. EC 7.308 (2) <br /> ~w~I <br /> 4.B IMPROVED PUBLIC WAY <br /> For purposes of surface restoration and maintenance responsibilities of the permittee, an <br /> improved public way is a public right-of-way upon which hard surface improvements such <br /> as street and alley pavements, public sidewalks, or bicycle paths have been constructed. <br /> The permittee is responsible for maintaining surface restoration of a utility or right-of-way <br /> cut upon an improved public way, until such time as the City performs a street <br /> reconstruction or overlay upon the affected area. EC 7.308 (1) <br /> 4.C UNIMPROVED PUBLIC WAY <br /> For purposes of surface restoration and maintenance responsibilities of the permittee, an <br /> unimproved public way is a public right-of-way or public utility easement upon which hard <br /> surface improvements such as street and alley pavements have not been constructed. <br /> The permittee shall be responsible for maintenance of surface restoration of work <br /> performed within an unimproved public way for a period of one year commencing upon the <br /> completion of the work.
