Now, therefore, based on the above findings, and the findings attached as Exhibit <br /> C hereto and adopted and incorporated herein by reference, I hereby adopt the following <br /> Construction Within and Use of the Public Way Rule R-7.302 to provide: <br /> CONSTRUCTION WITHIN AND USE OF THE PUBLIC WAY <br /> ADMINISTRATIVE RULE R-7.302 <br /> R-7.302-A Construction Within and Use of the Public Way -Policy <br /> In order to create attractive and healthy neighborhood environments and to protect <br /> the public's right for safe unobstructed use of the public way, applicants wishing to perform <br /> construction in, or use the public way, shall first obtain a written permit and shall conform <br /> with the standards and procedures provided for in these rules and the provisions, <br /> specifications, and conditions contained within the manual on Utility and Right-of--Wax <br /> Permits. Construction Within and Use of the Public Way Policies and Procedures, <br /> attached hereto as Exhibit A and adopted herein. <br /> R-7.302-B Definitions. <br /> Applicant or Permit Applicant. The responsible person who applies for aright-of- <br /> way cut permit. <br /> City Engineer. The Director of Public Works of the City of Eugene, or the Director's <br /> designee. <br /> Conduit. An underground pipe or other structure constructed and used to contain <br /> lengths of wire, cable or other transmission media. A conduit does not include pipes <br /> constructed and actively used for the purpose of conveying natural gas, water, stQrmwater, <br /> wastewater, or other liquids. <br /> Elevation view. The above ground height and width of a structure when viewed from <br /> the center line of the public way at a point perpendicular to the structure. <br /> GIS format. The format of electronic information, as established by the City <br /> Engineer for incorporation into the City's Geographic Information System (GIS). <br /> Major Facility Upgrade. The extension or reconstruction of any facility in which a <br /> wire, cable, conduit, or pipe greater than 400 linear feet in length is installed or replaced <br /> within the public way. <br /> <br /> Administrative Order - 2 o2iiass <br /> <br />
