~ C1TY OF EUGENE <br /> Department of Public Works <br /> Policies and Procedures <br /> Utility and Right-of--Way Permits <br /> olnstruction Within and Use of the Public Way <br /> Section 1 GENERAL <br /> The provision herein shall go into effect February 12, 1998. <br /> 1.A AUTH RITY <br /> This operatio a( policy and procedure document was prepared and enacted under the <br /> administrative and rule-making authority granted the City Manager by Section 2.0:19 of the <br /> Eugene Code 1971 and the authority granted the City Engineer by Section 7.007 of the <br /> Eugene Code 1971. <br /> 1.B INTR D~UCTION <br /> Street rights- f-vvay and public utility easements (public way) are intended for the use of <br /> all citizens fo vehicular and pedestrian movement, access to private property and the <br /> delivery of es ential utility, fire, police and transportation services. Section 7.007 of the <br /> Eugene Cod 1971 charges the City Engineer with the responsibility of protecting the <br /> public's rights ithin the public way for these purposes. That responsibility is discharged <br /> in part by con rolling construction and special uses of the public way through the issuance <br /> of permits. S ction 7.302 of the Eugene Code, 1971 speca+es that the City Manager issue <br /> administrative rules related to construction within and use of the public way. This manual <br /> has been ado fed as a part of Administrative Rule R-7.302 under the rule-making authority <br /> granted the ity Manager. <br /> <br /> The primary c ncern when exercising this authority is to prevent personal injury, property <br /> damage and i convenience to the public resulting from improper construction practices and <br /> right-of-way u es by contractors, public utilities, public agencies and property owners.
