r r ADMINISTRATNE ORDER NO. 58-98-10 of the 4 City Manager Pro Tem of the City of Eugene C CERNING NOTICE OF INTENDED AMENDMENT OF MWMC PRO SIONS OF SYSTEMS DEVELOPMENT CHARGE METHODOLOGY The 'ty Manager Pro Tem of the City of Eugene finds as follows: A. Sections 2.020 and 7.705 of the Eugene, Code, 1971 authorize the City Manager of the i City of Eugen to determine and set fees and charges to be imposed by the City for services, goods, use of municipal p operty, and licenses and permits, and specifically systems development charges. Section ~I 7.710 of the ugene Code, 1971 further authorizes the City Manager to adopt and/or amend by administrative order, the methodologies used for establishing the systems development charges, and provides this ay be effected concurrent with the establishment or revision of a systems development charge. B. In accordance with the procedures set forth therein, I intend to amend the Systems Development barge Methodology relating to the Metropolitan Wastewater Management Commission (MWMC) by i creasing fees for the Regional Wastewater Systems Development charge, eliminating the shopping cente category from the rate table as this type of establishment is more accurately described by ! other categori s in the table, and updating the MWMC credit table. MWMC has completed an annual update of the v lue of its assets, the value of proposed future improvements, and the value of prior property tax payment co tributions for existing vacant land. These changes are the basis for the proposed increase ~ in the MWMC SDC rates. C. I find that the revisions to the Systems Development Charge Methodology and the fees as set forth in E ibit A (Table 1-page 3, Table 5- page D-9, Attachment 3-page D-10, Attachment 4-page D-11, Calcula ions-page G-4, and Section 2.3-page G-6) hereto are consistent with adopted policies and ordinances of e City, in conformity with applicable state law, and should be implemented effective July 1, 1998. Tho e portions of the Systems Development Charge Methodologies adopted by Administrative Order No. 58- 7-02-F-2 and Administrative Order No. 58-97-07-F, in conflict herewith should be amended as of that effec ive date. On th basis of these findings, I order that: 1. Copies of the Notice be provided to the Mayor and City Councilors, published in the Register Guar , a newspaper of general circulation within the City, posted at four public locations, and ' be made availa le for interested persons at the offices of the City Manager at 777 Pearl Street, Room 105, the City Publi Works Building Lobby, 858 Pearl Street, the Permit and Information Center Lobby, 999 W. 10~' Avenu ,and the Eugene Public Library, 100 W. 13"' Avenue, during normal business hours (8:00 a.m. to 5:00 p m., Monday through Friday, exclusive of holidays, except for the Library). I', 2. All persons desiring to comment thereon shall submit written comments as set forth in the Notice.
