71 <br /> ADMINISTRATIVE ORDER N0.58-98-11 <br /> ~ of the <br /> City Manager Pro Tem of the City of Eugene <br /> CONCERNING NOTICE OF INTENDED INCREASE IN <br /> MWMC SEPTAGE USER FEES <br /> The C ty Manager Pro Tem of the City of Eugene finds as follows: <br /> A. Section 6.411 (formerly Section 7.020) of the Eugene, Code, 1971 authorizes <br /> ~ the City Man ger to determine and set fees and charges to be imposed by the City for <br /> wastewaters rvice, regional wastewater service, and stormwater service. In accordance <br /> with the proc dures set forth therein, and consistent with the requirements of Section 2.020 <br /> of the Euge a Code, 1971, on May 23, 1996, Administrative Order No. 58-96-10-F <br /> establishing ewer user rates for the fiscal year commencing July 1, 1996 was adopted. <br /> B. Pursuant to Subsection 6.411(1) of the Eugene Code, 1971, I have <br /> conducted a investigation of the revenue needs of the City in providing these services and <br /> reviewed the recommendation of the Metropolitan Wastewater Management Commission <br /> (MWMC). <br /> C. The MWMC has proposed to increase the septage user charge for MWMC <br /> wastewater ervice. The proposed increase is a one-year surcharge to be added to the <br /> current pert ousand gallon (kgal) septic rate for FY99 to recoup the estimated cost of <br /> septage faci ity improvements. MWMC approved the fee increase on April 22, 1998, as <br /> part of its F 9 budget adoption process. <br /> D. Based on that investigation and recommendation, (intend to revise the <br /> ~ septage use fees for MWMC wastewater service as set forth in the Notice of Intended <br /> Fees attach d as Exhibit A hereto and incorporated herein by reference. I find the <br /> ~ proposed fe s are in compliance with the Council's directive that the costs of providing <br /> such servic s be recovered from the beneficiaries of the services, are consistent with <br /> ~ applicable fe era! and state regulations and the recommendations of MWMC, are based <br /> on the adop ed budget of MWMC, and should be implemented effective July 1, 1998. <br /> Those porti ns of the wastewater and stormwater rate schedules adopted by <br /> Administrati a Order No. 58-96'-~10-F in conflict herewith should be amended as of that <br /> effective dat . <br /> On th basis of these findings, l order that: <br /> 1.
