ADMINISTRATIVE ORDER NO. 58-98-13-F <br /> of the <br /> AIRPORT MANAGER <br /> REV SING THE AIRLINE SIGNATORY AND NON-SIGNATORY RATES; <br /> RATIFYIN THE UNAMENDED FEES IN THE AIRPORT FEE SCHEDULE; AND <br /> REPEALIN ADMINISTRATIVE ORDER N0.58-97-18-F. <br /> The irport Manager of the City of Eugene finds as follows: <br /> A. Authority is granted to the City Manager of the City of Eugene under Sections 2.440 <br /> to 2.442 of th Eugene Code, 1971 to set fees and charges for the use of the Eugene Airport. The <br /> City Manager as further delegated that authority to the Airport Manager under Airport Rule 8.4.2. <br /> B. Pursuant to that delegated authority Administrative Order No. 58-97-18-F was issued <br /> on September 25, 1997 revising and ratifying the Airport Fee Schedule attached as Exhibit A thereto. <br /> On August 1 1998 I issued Administrative Order No. 58-98-13 proposing the revision of the <br /> Airport Fee S hedule by amending the airline signatory and non-signatory rates set forth in Sections <br /> 2, 4, and 5 o that Fee Schedule, as set forth in the Notice of Intended Fees attached as Exhibit A <br /> thereto. <br /> C. The Notice was provided to the Mayor and City Councilors, posted at two locations <br /> at the Airpo t on August 14, 1998, published in the Register Guard, a newspaper of general <br /> circulation w thin the City on August 14, 1998, and made available for inspection by interested <br /> persons at the offices of the Airport Manager, 28855 Lockheed Drive, Eugene, Oregon 97402 during <br /> normal busin ss hours (8:00 a.m. to 5:00 p.m., Monday through Friday, exclusive of holidays). <br /> D. The Notice provided that written comments would be received thereon for a period <br /> of 15 days fro the first date of posting and publication. The only comment received within the time <br /> or in the ma er required by the Notice was from United Airlines, objecting to the inference that the <br /> City's rates d charges were based on the level of such charges at other airports. Although the rates <br /> and charges t other airports has been considered, as required by provisions of the Eugene Code, <br /> 1971, the pro osed increase in the City's rates and charges is based on increases in its budgeted costs. <br /> D. I find that the airline signatory and non-signatory rates set forth in Sections 2, 4, and <br /> 5 of the Airpo Fee Schedule should be revised as proposed, the other fees set forth therein ratified, <br /> and Administ ative Order No. 58-97-18-F and the Airport Fee Schedule adopted therein repealed, <br /> as of the effe tive date of this order. <br /> On th basis of these findings and the findings in Administrative Order 58-98-13, I order that: <br /> 1.
