I <br /> ADMINISTRATIVE ORDER N0.58-99-15-F <br /> of the <br /> ~ City Manager of the City of Eugene <br /> I <br /> ESTABLISHING FEES FOR ENGINEERING SERVICES <br /> ~ F R PRIVATELY CONSTRUCTED PUBLIC IMPROVEMENTS <br /> ' ND REPEALING ADMINISTRATIVE ORDER NO.58-97-12-F <br /> The C ty Manager of the City of Eugene finds as follows: <br /> A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to determine <br /> and set fees an charges to be imposed by the City for services, goods, use of municipal property, and <br /> licenses and p rmits. <br /> B. In accordance with the procedures set forth therein, and the further authority of <br /> Section 7.130 f the Eugene Code, 1971, on July 9, 1999 I notified the Mayor and City Council that <br /> I intended to epeal the currently effective fees for engineering services for privately constructed <br /> public improv ents as established by Administrative Order No. 58-97-12-F on July 14, 1997. The <br /> Notice was so posted at two locations at Gity Hall on July 9, 1999, and made available for <br /> inspection by ' terested persons at the offices of the City Manager, 777 Pearl Street, Eugene, Oregon <br /> 97401, during normal business hours (8:00 a.m. to 5:00 p.m. Monday through Friday, exclusive of <br /> holidays). Th Notice provided that written comments would be received thereon for a period of 15 <br /> days from the ate of posting. No comments were received within the time or in the manner required <br /> by the Notice. <br /> C. I find that the fees set forth in Exhibit A hereto are consistent with applicable policies <br /> and directives f the City Council, comparable to the fees established in other jurisdictions and private <br /> businesses for roviding such services, are based on the hourly rates of engineering employees, and <br /> are necessary 'n order to comply with the City Council's directive and the requirements of Section <br /> 7.130 of the E gene Code, 1971 that the fees charged for these services recover the City's full costs, <br /> including pl review, engineering, inspection and overhead costs.. <br /> On th basis of these findings, I order that: <br /> 1. The fees set forth in Exhibit A hereto are hereby established as the fees to be charged <br /> for the~servic s set forth therein, effective 12:01 a.m., August 1, 1999. <br /> Z. Administrative Order No. 58-97-12-F, and the fees established therein are repealed <br /> as of midnigh ,July 31, 1999. <br /> Date this S day of August, 1999. <br /> James R.
