f <br /> ADMINISTRATIVE ORDER N0.58-99-20-F <br /> of the <br /> City Manager of the City of Eugene <br /> ESTABLISHING AMENDED MWMC SEPTAGE USER FEES <br /> AND REPEALING ADMINISTRATIVE ORDER N0.58-98-11-F. <br /> The City Manager of the City of Eugene finds as follows: <br /> A. Section 6.411 (formerly Section 7.020) of the Eugene, Code, 1971 authorizes the City <br /> Manager to determine and set fees and charges to be imposed by the City for wastewater service, <br /> regional wastewater service, and stormwater service. <br /> B. In accordance with the procedures set forth therein, on September 14, 1999 I issued <br /> { Administrative Order No. 58-99-ZO proposing an increase in MWMC septage user fees a`s set forth <br /> in the Notice attached thereto, and the revision of the rates adopted by Administrative Order No. 58- <br /> 98.11-F. <br /> I' <br /> C. Copies of the Notice were provided to the Mayor and City Councilors, the news <br /> madia, any person who had requested notice, and posted at two locations at City Hall on September <br /> 19 1999. The Notice was also published on September 19 and September 22, 1999 in the Register <br /> Guard, a newspaper of general circulation within the City, and made available for inspection by <br /> ~ interested persons at the offices of the Eugene/Springfield Regional Water Pollutiott Control Facility, <br /> 41p River Avenue, Eugene, Oregon 97404, during normal business hours (7:30 a.m. to 4:00 p.m., <br /> Mpnday through Friday, exclusive of holidays). The notice was subsequently provided to interested <br /> governmental agencies (including the United States Environmental Protection Agency, the <br /> Department of Environmental Quality, MWMC, and the Eugene Water & Electric Board), each of <br /> whom waived any irregularities in the provision of notice and consented to the proposed septage user <br /> fee increase. <br /> D. The Notice provided that written comments thereon could be submitted for a period <br /> of 15 days from the first date of publication and posting, or at a public hearing to be held on <br /> September 30, 1999. No written comment was received within the time or in the manner required <br /> by the notice, and only one person offered testimony at the public hearing. The testimony at the <br /> <br /> ~ 'pudic hearing was not in opposition to the increase in rates and therefore no revisions are being <br /> ,made to the rates as proposed. <br /> E. Pursuant to Subsection 6.411(1) of the Eugene Code, 1971, I have conducted an <br /> investigation of the revenue needs of the City in providing these services and reviewed the <br /> recommendation of the Metropolitan Wastewater Management Commission (MWMC). <br /> F. Based on that investigation and recommendation, and the findings set forth herein, <br /> I find the proposed septage user fees are in compliance with the Council's directive that the costs of <br /> Administrative Order - 1 <br /> <br />
