~T~ i .y ADMINISTRATIVE ORDER N0.58-99-22 of the City Manager of the City of Eugene CONCERNING NOTICE OF INTENDED AMENDMENT OF PORTIONS OF THE REDEVELOPMENT FEES AND CREDITS PROVISIONS OF THE CITY OF EUGENE'S SYSTEMS DEVELOPMENT CHARGE (SDC) METHODOLOGY. . i i The City Manager of the City of Eugene finds as follows: A. Sections 2.020 and 7.705 of the Eugene Code, 1971 authorize the City Manager of the City of Eugene to determine and set fees and charges to be imposed by the City for services, goods, use of municipal property, and licenses and permits, and specifically systems development charges. Section 7.710 of the Eugene Code, 1971 further authorizes the City Manager to adopt and/or amend by administrative order, the methodologies used for establishing the systems development charges, and provides this may be effected concurrent with the establishment or revision of a systems development charge. B. On November 8, 1999 Ordinance No. 20175, which amended provisions of the ti Eugene Code, 1971 with respect to the manner in which SDC credits for redevelopment are determined, was adopted by the City Council and approved by the Mayor That ordinance will r ~ become effective on December 9, 1999, and the current SDC Methodology should be amended ~ consistent with those revised provisions, and an administrative fee established for reviewing credits Ii! for redevelopment projects. C. I therefore intend to amend Sections 1.2, 2.2.1, 7.0 and 7.2.3 of the City of Eugene SpC Methodology with respect to the manner in which administrative charges and credits are !I computed for redevelopment that constitutes a change of use of a building in its entirety; add a ~ definition of "redevelopment" to Appendix A of the Methodology; and amend the fees for ~ administration in Section 2.6 of Appendix F of the Methodology, as set forth in the Notice of ~ Intended Amendment of Systems Development Chazge Methodology, Fees, and Credits attached as I~ Exhibit A, including the attachment thereto, which are incorporated herein by reference. D. I find that the proposed revisions to the SDC Methodology and administrative fee as 'j set forth in Exhibit A and its attachment aze consistent with adopted policies of the City, in conformity with applicable state law, and necessary in order to be consistent with recently adopted j provisions of the Eugene Code, 1971. Incompliance with prior direction from the Council and the t 'f memorandum submitted at the time the ordinance was considered, the proposed revisions should be j,' implemented retroactively with respect to redevelopment permits in process on and after August 9, ~ 1999.
