I <br /> i <br /> <br /> ~ 7.407 (3). <br /> 7. .3 Previous Payment or Use <br /> In calculating the credits given under this section, the City Engineer shall apply credit only <br /> ~ to the developments for which the previous use or payment can be verified. Credit for <br /> pr vious use will be based on the most recent documented use except-, in the case of <br /> re evelopment that will change the use of a building in its entirety, when the credit for <br /> pr vious use will be based on the previous most intense verifiable use per system. In this <br /> s cific case of redevelopment, the credit calculation will be performed independently for <br /> e ch system which may resu?t in different phases of the use of the site being the basis of <br /> co parison. The burden of proof is on the applicant to provide adequate documentation. <br /> 7.2.3.1 Pre-existing Development Credit <br /> <br /> I <br /> When an applicant for development of vacant land establishes that the land was <br /> previously improved with structure(s) which were demolished, a reduction for the <br /> demolished structure(s) shall be granted provided a reduction for the demolished <br /> structure(s) has not been previously given. <br /> 7. .4 City Cost of Construction Credit <br /> In calculating the credits given under section 7.2.1 and 7.2.2, the City Engineer shall <br /> es imate the cost of the capital improvement based upon what the City would pay were <br /> it t construct such improvements. <br /> 7. .5 Revenue Collection for Equivalent Assessment or Special Benefit Credit <br /> Wen an equivalent assessment or a special benefit assessment is collected when <br /> <br /> ~ pr perty connects to a public improvement for which the City has granted a credit under <br /> <br /> ~ 7. .2 (3) above, the revenue collected (net of the costs of collection) shall be deposited <br /> in he SDC fund for the system to which connection was made and for which the credit <br /> w s given unless the SDC fund has been reimbursed for the credit from other City funds. <br /> If he SDC fund has been reimbursed in advance from other City funds, the revenue <br /> ~ ~ co lected will be deposited to the City fund which reimbursed the SDC fund. <br /> 7.3 R vocation of Credit and Impact Reduction <br /> A credit r impact reduction which has been applied to reduce SDC fees may be revoked and <br /> the unp id portion of the SDC reimposed as a lien against the property, within the time required <br /> by thes Methodologies, if: <br /> (1) Th associated capital improvement for which SDC credit has been given is not <br /> co structed or completed as required, or fails to function as designed; or <br /> (2) Th associated reduction program for which an impact reduction has been approved is <br /> no instituted or is modified without the approval of the City Engineer, or ceases to <br /> ~ t fu ction as designed. <br /> Such re ocation shall not occur until ten days prior written notice has been given to and an <br /> I' opportu ity to be heard afforded the permittee and property owner.
