o <br /> o p~ <br /> ~ ~ ADMINISTRATIVE ORDER N0.58-00-17-F <br /> of the <br /> City Manager of the City of Eugene <br /> AMENDING PORTIONS OF THE SYSTEMS DEVELOPMENT <br /> ~ .CH RGE (SDC) METHODOLOGY, AND REPEALING ADMINISTRATIVE <br /> 3 ORDERS N0.58-99-22-F and 58-00-14-F. <br /> <br /> E <br /> Th City Manager of the City of Eugene finds as follows: <br /> A. Sections 2.020 and 7.705 of the Eugene Code, 1971 authorize the City Manager of <br /> the City o Eugene to determine and set fees and charges to be imposed by the City for services, <br /> goods, use f municipal property, and licenses and permits, and specifically systems development <br /> <br /> ~ charges. S ction 7.710 of the Eugene Code, 1971 further authorizes the City Manager to adopt <br /> and/or am nd, by administrative order, the methodologies used for establishing the systems <br /> developme t charges, and provides this may be effected concurrent with the establishment or <br /> revision of a systems development charge. <br /> B. In accordance with the procedures set forth therein, on July 13, 2000, I issued <br /> Administr ive Order No. 58-00-17 and notified the Mayor and City Councilors that I intended to <br /> amend the City of Eugene SDC Methodology by adopting the revised regional Metropolitan <br /> ~ Wastewate Management Commission (MWMC) wastewater SDC rates as calculated by MWMC, <br /> <br /> ? which repr sented a 17.1 % fee increase. <br /> C. The Notice was also posted on July 14, 2000 in four public locations within the City <br /> and publish d on July 16, 2000, in the Register Guard, a newspaper of general circulation within the <br /> City. In a dition, copies of the Proposed Amendments to the Systems Development Charge <br /> t Methodolo were made available for inspection by interested persons at the City Manager's Office, <br /> 777 Pearl S eet, Room 105, the Human Resource and Risk Services Office, 777 Pearl Street, Room <br /> 101, the P lic Works Building Lobby, 858 Pearl Street, and the Eugene Public Library, 100 West <br /> 13`" Avenu ,during normal business hours (8:00 a.m. to 5:00 p.m., Monday through Friday, <br /> ~ exclusive o holidays). The Notice provided that written comments could be submitted thereon for <br /> a period o 30 days, through August 14, 2000. No written comments were received. However, <br /> during the c mment period staff identified some corrections to typographical errors, and other minor <br /> { cosmetic c ges needed to improve clarity and readability, all of which have been incorporated in <br /> the attache Exhibit A. <br /> E <br /> D. Based on the findings and staff recommendations set forth above, I find that the <br /> <br /> ~ revisions t the Systems Development Charge Methodology, fees, and credits as proposed by <br /> ~ Administra ive Order 58-00-17 and the corrections reflected in Finding C above and incorporated <br /> in Exhibit hereto are consistent with adopted policies and ordinances of the City, are in conformity <br /> ~ with applic ble state law, and should be implemented effective September 5, 2000. <br /> i <br /> Administra ive Order - 1 <br /> <br />
